Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Posting for a good friend.. I have already advised her, but want to clarify some points, should anyone have direct information on such matters.
Today i accompanyed her to the dreaded dentists, have been doing so for the last year, due to her having major work carried out, might i add that she works full time hence pays for the treatment she recieves, (not private treatement like) Three months ago she had a top part denture fitted and part bottom denture fitted, she has been back on two occassions to get them re-adjusted, each time the dentist charged her the routine check up price, Question one: Don't adjustments come under the fees she already paid for the dentures, ie slight adjustments as per the jaw bones shrinking etc.
The dentures still don't fit correct in her mouth and since getting them fitted, she hasn't been able to eat solid foods while the teeth are in place, hence she takes them out to eat soft foods.
Today we drove to the dentists to have them adjusted again, her appointment been arranged two weeks ago for 15.20 arriving 10 minutes early, we sat, at 15.50 she still hadn't been seen by the dentist, and i had to get off for a appointment of my own else-where, with her been scared she asked for another appointment due to not been seen today, of which the receptionist gave her one for two weeks time, not even a sorry came to my friend on behalf of the dentist, infact the receptionist even struggled to give her eye contact.
While we were there waiting, another lady came into the rest waiting area, she had a appointment at 15.25 but hadn't arrived untill 15.40 just 15 mins late, the receptionist informed that lady she had missed her appointment hence had to re-book and a charge for missing her appointment had to be made upon her.
Question Two: Can my friend put a claim into the dentist for them failing to conclude a appointment ie them failing in there duty to keep to appointment? End of the day, she had finished work early to attend this apppointment, the cost of getting to the surgery etc.
I have informed her to pen a letter together, high-lighting the concerns she has and the costs accurred, and to seek at least a apology and costs for the time wasted waiting ie half hour, standard rate, and costs of the travlling by car, price per mile, and also for writing the letter of complaint, standard pricing. I have also asked her to seek whether the adjustments should be free, rather than get charged every time she visits to get the adjustmenst done.
I think the above is fair to seek given the cirmcumstances, after all if she was late or missed the appointment, there would charge her for doing such. Should anyone feel that there is no case for the dentist to answer, then fair enough, she will put it down to every day accurrances, but me been me, i have expressed her to presue the matter. Thanks for reading and take care.
Moderator: Shywazz been tired i couldn't find the "post new thread" on the dentists section, please move as required to correct area, time for bath and bed as work at 5am yeeks thanks. 8)
Yes she has a viable claim...........the dentist has breached contract and failed to provide the services contracted. As dentist charges in reverse the argument of reciprocity should suffice.
Also how much has she paid for what would appear to be shoddy workmanship?

Thanks for replying, friend texted me this morning she wrote and posted letter this morning. Asked her about the costs she has made for the treatments.
1st part of treatment cost her £400 which included one extraction, 2 fillings, 9 root canels, (which failed hence the second course of treatment) 2 gold crowns.....
2nd part of treatment (now under the new charges) included 9 extracations ( due to the above root canels failing ) and 2 part dentures one holding ( top 5 teeth) bottom holding 4 teeth. cost her £189.00
Two further visits to have the dentures tightened charged at check up fee £ 15.50.....
She has another appointment booked for mid June to have the dentures re-made this time PRIVATELY, hence the cost is £1000.00 as the others don't enable her to eat with them in, and according to the dentist, the Private dentures are made out of differant substances/materials? which he says will suit her better. :-|

This isn't my area but I'm sure that something like a filling is guaranteed for 12 months@ I pay for treatment and had to have a filling redone twice as it wasn't settling properly & I wasn't charged. Eventually had to have the tooth out ( it was at v back so I wasn't too fussed ) and because I had already paid for the filling but it was within the 12 month time period I had the extraction done for free.
You would think that if fillings are covered for 12 months so should dentures be? Hopefully someone with more knowledge will be along but I'll try and find out more...
If a client has a complaint about private dental treatment which s/he cannot resolve with the practitioner concerned, s/he can contact the Dental Complaints Service. This is a free independent service which tries to resolve complaints about private dental services, including complaints about wrong or poor treatment and complaints about unclear pricing, avoidable delays and rudeness. The service cannot accept complaints which arose prior to 24 February 2006. A complaint about the competence, conduct or behaviour of clinical staff that raises issues of patient safety should be directed to the General Dental Council.

Hello everyone, thought it best i up-date this thread as things are going from bad to worse for my dear friend.....following all the dentists advice, she went ahead with the private section of getting new plates for the price of £1100.00 which she duely paid by card on Nov 6th this year... The nhs costed plates at £400+ werent enabling her to eat with them in and after 12 mths of having them wasn't able to wear the bottom plate due to bad fitting, albeit serveral visits to the dentist to put correct...All to no avail... The treatment to get the mouth ready to accept the new plates started back in Sept this year, where the removal of just one tooth and gum treatment, which had not took to treatments to save, well she has lost 15 teeth in total now, bless her cotten socks, but she braves the discomfort and continues to hold things together...
In the last 6 weeks she has visited the dentists once even twice per week to pre-set the mouth, have bites and fittings, also had three infections which had to be treated by antibiactics, which slowed the inserting of the plates some weeks....Every week been told the plate had to go back to the lab for minor adjustments, To say things are getting to her now is a understatement, for the last three weeks she has been informed the new plates would be ready, each time going home dis-appointed due to them not fitting or the lab hadnt returned them, The last straw came yesterday, when she returned home to her waiting hubby, in tears due to the plates been given to her, yet there just didnt line up straight within the mouth, and each time she spoke the top plate dropped down, the clasps on the top plate were holded upon two top teeth, one still under antiboatics, as not healing good, the pain was in her eyes, yet the dentist let her go home with the new plates in....
This morning, myself drove her and the husband to the dentists, to explain that the plates were not fitting correctly, after seeing the dentist, he stated three times the plates looked okay and that it would take time to adjust to them, even though the plate was visable to all that there didnt fit... After been in the dentist nearly two hours, the dentist agreed to send the plates back to the lab where there were made as the mistakes are down to them , This won't be done untill Jan 3rd when the dentist returns from the seasonal holidays, he has explained that re-bites and moulds will have to be taken, ie back to square one which she was in sept...So in whole, constant dentists visits infections pain and tears, oh and not forgetting the £1100.00 that the dentist now has in his pockets, she sits at home, with no plates and christmas without plates/teeth...
She isn't one to complain about such, but i am so annoyed by the treatments given to her, i only visit them twice per week but each visit gets worse as i see her suffering. I want to get her to complain to the dental assocation, but shes scared this will delay the plates even more, and might even lead to her dentist not treating her in future?
To me, although i'm just a outsider, she endured all the pain and suffering when getting ready for the nhs plates, which from day one never really fitted which the dentist didnt seem to care much, now she has gone private for new plates, the suffering and delays continue, does she just bite the bullet so to speak or complain to the dental assocation?

Im suprised you ask this question, your friend is aware of the option to complain as you passed the details of the DA to her in May this year. Sorry if l sound harsh, l just worry that you are falling victim as l have in the past i.e. unwittingly allowing the friend to transfer her frustrations, angish, etc onto you, and you do the running around when it should be the person who is demostrating that she can tackle these issues by at least taking some steps to resolve the problem, with emotional support from good friends of course.
