Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Tomorrow the 2 weeks will be up after sending second letter or lba with no reply at all....
I have just realised that i have sent the prelim and second letter to my branch not the customer relations dept.
Should i carry on with my claim on mcol or do you think i should send a copy of my first 2 letters to borehamwood giving them some more time (14 days say) before starting my claim...?
Okay so after trawling the forums i have decided to send a letter to borehamwood with copies of my other letters plus schedule of charges etc giving them another 14 days to make me an offer before starting court action.....
i will be sending it off tomorrow morning so if anyone thinks otherwise reply before then...
if there is anyone out there?
i am.... sorry though, !!!! I don't think that you need to re-send the letters (although do so if you wish) The letters will automatically be forwarded onto the right dept. I myself sent my prelim and lba, then amended my LBA and sent it again to Shenley Road, Borehamwood and have not had any acknoweldgement, so I dont think it matters overly where you send the letters at this point, although check the stickies for the exact right address for the court stage.
I won against MBNA, Nat West , Barclays, Barclaycard and PPI payments from Barclaycard
Abbey National still to go.... what will I do with my spare time?
Okay well i think i am going to sleep on it....
working from home tomorrow so either way have time to sort it out...
think its best to just get on with it then....
maybe try phoning them first to see if anything is happening...
cheers..
Standingupformyself is absolutely spot on with this advice - your branch will merely have forwarded your letters on. Personally, if I was you - I'd file at court (either MCOL or with N1 in person at your local county court. This link helps you to decide which route to take Moneyclaim and hardcopy claim compared).
If you're really, really unsure about this though (i.e., because you've sent prelim and lba to local branch), you could send another LBA to the Borehamwood address giving them 7 days to respond before you file at court (and pointing out that you've already previously sent prelim and LBA). However, this may merely delay the inevitable and you'll probably find yourself filing at court anyway.
Good luck - let us know what you decide to do as we're all here to help! Hedgey xxx
I have spent a lot of time reading this forum and appriciate the the advice..
Its brilliant the amount of help people like you and others give...
My only concern is that i work away from home a lot and dont want to mess my claim up by not being here for a deadline during the claim process...
But i have made up my mind i am going to call in the morning for some kind of acknowledgement...failing that i will start my claim online...and it will surely be easier to manage if i am away from home...
Glad to be of help - I know how hard it can be to make the decision to file at court.
the good news is though, that once it gets to the court stage - things seem to slow down a little! You're basically waiting for deadlines that are nearly always 14 or 28 (etc) working days away - which should give you time to have your responses ready.
Good luck, and keep us updated with your progress - hedgey xxx
Okay so spoke to a lovely lady at customer services.....they say they have recieved my claim....yey!!
But they have not made a decision yet and i should wait until 2 months from when they recieved the claim for a decision...boo!!
Well i have decided i am going to send a letter today saying i am going to give them 7 days (as a goodwill gesture) to refund me or i will start with court action...

Good for you. Don't let them set the timescales - it is your claim. 7 days is very generous given that they have had so many days already but it also shows that you are prepared to act reasonably - courts like that.

Letter sent giving them another 7 days to respond before action...
not holding my breath though...
gives me some breathing space cos of work also...
and enjoy the "bank" holiday... hee hee....
Good for you - you sound way more positive than you did yesterday! At least you know that you're working to your timescales now and not nasty wests! Go get that cash back!!!
Hmmm well yes i was never really not feeling positive...
just unsure about best move...
now i have spoken to them and confirmed they have recieved my request i feel like i am getting somewhere..
i have no qualms about going to court at all when/if it comes to it...in fact financialy it would be preferable obviously that interest is mine also...
and it would be quite exciting...
Best of luck, offers usually come from Nutwest approx. 8 weeks after lba, but if I was you I wouldnt wait for it. I would file at court and dictate your own timescale on this one. Your choice thought, no body could blame you for going either way on this, but ultimately YOU WILL WIN AND THE MONEY WILL BE YOURS AGAIN, its just a case of when, do you wait for offer, if one comes at all, or do you dictate the terms and file at court. I know which I would do, but each to their own. All the very very very very best.................... whatever you decide. Fendy xxxx

Morning fendy....i have no intention of waiting the 8 weeks...they got 7 days from now...just checked and the letter i posted yesterday was signed for at 9.10 this morning at borehamwood......unless i am away working in which case they might have about 10 days or something...he hee....XX
Okay so i have just got back from working away in that london and surprise surprise still nothing from Natwest...
Well i was not really expecting anything...
I want to start action now but dont have the funds so will wait and see if i can on friday...
if not then i have a problem in that i will be working away again for 5 weeks and will have trouble even getting my mail let alone starting action...
so there you go...
hope everything goes well for everyone if you dont hear from me for a while....
Hi again tant............. hopefully, you'll be able to raise the funds to file either N1 at court or via MCOL. Totally understand though ............ I had to wait 2 weeks to file myself due to lack of funds!!!
Again though - if you can't raise the cash by Friday.......... hopefully you can manage (at some point) to get onto MCOL via a laptop somewhere along the line so's you can file even though you're not at home (make sure you've got electronic access to your schedule of charges if this is the case though - just to get the up to date s69 8% court interest calculated on the schedule).
Do you think it would be advisable to start mcol while away...is everything then online...?
I wont have access to a printer while away but i will have my laptop and occasional internet access...
I suppose i could print out everything i might need before hand but i think i would be too worried....
Hmm need to think about this one...
Hope evrything is going twith your claim not had chance to catch up yet...
Being self employed makes it impossible to be sure but if not on this friday then i would hope the following one....
Why would i think you are being presumptious??
