I have had a claim with Egg concerning the £20 over the limit fees for several months now, making my first request for refund last November!
The scenario goes as follows - March 2006 the account did go over its limit but I made an additional payment almost immediately to counteract this so when it came to the statement being issued, I didn't get the over the limit charge.
However, that very thing happened as consequently, I then refused to make a further additional payment when they called me up to request this.
So month on month, they continued to apply this £16 charge up until January of this year! £16 x 10 months = £160!!
I wrote an e-mail to them in November and got the standard "you signed an agreement, we inflict the charge if you breach that" reply back. I then had a couple of phone calls from them where I reiterated the whole scenario to them and they continued to refuse to budge. In January, I had to make a trip to Germany so I did make a small payment of around £125 to reduce the balance to a level I could cope with in case I needed to use the card. When I got to Germany, I did need to use the card since I had to hire a car for a meeting from an airport. Was very annoyed when they couldn't accept it and even more annoyed when I phoned Egg to be told I hadn't paid enough for them to permit any payments through - I was absolutely livid that a) I was left on the line holding for over 25 minutes on my mobile from Germany and b) that despite what I told them, they would do nothing.
On my return, I wrote a complaint to the Financial Omburdsman Service and believe it or not, they then wrote to me pretty quickly saying they maintain the charges are correct but as a Gesture of Goodwill, would refund me £15 for the call charge from Germany. Whilst I accepted this, I reiterated they would need to refund my entire charges because these are deemed as unjustified and disproportionate.
The fos are dragging their feet a bit as is Egg - didn't know if there was anything I could do to gee them up at all. I intend to insist they refund the £160.00 plus the interest they've applied on my account up until when the charges stopped, plus late payment interest. Can I do this??
Speedbird, fos is avalanched under with cases. FOS is expected to rule in your favour as I understand not one card or bank ever contested a claim processed via the FOS. If it is of any satisfaction to you, FOS I believe will additionally charge Egg £320 for their time.
If you point out to Egg that by paying your refunds plus Contractual Interst direct to you they will save themselves having to pay out exactly the same PLUS £320 to FOS, they should understand it makes no sense. However Egg suffers from muddle more than from conspiracy, and it seems everything depends on who handles your case.
V-E Day thread contains an index of winners, so far the score line is Claimants 45 - Egg 0. However settlement time varies vastly, from 1 week to 54. I believe secure Eggmail works faster than letters. If you can get to Guy Harrison, the last time he settled within 1 day (IrishRose). Your Eggmail would do well to demonstrate you already know all about the move in this ritualistic dance, so no point both sides wasting valuable time. Perhaps try moc1982's Eggmail which scored within 2 days.
And say you KNOW the score, 45-0. They know it too.
