Recieved the banks defense today and paragraph 25 says they are entitiled to ofset any amount that I'm awarded against the over drawn account(s). I'd assume that they could only ofset against the account I'm suing them over, not the other account too. I had banking facilities withdrawn on my current account and a Flexiplan account when I couldn't keep up with payments and both are now with a DCA (they've bundled them together as one montly payment). Is it too late to reserve the claim adding that I wish to be payed any amount awarded by cheque only to avoid this?
