Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
1. they have sent me six years worth of statements, as i live in scotland can i only claim for the last five years due to scottish law
2. what do i do next is there a template letter to send off to the bank?
3. my charges total £2000 pounds but i can only claim for up to 1500 pounds in the small claims court how do i get round this, is it a case of submitting one claim for the first 1500 pounds then once that case has been dealt with submitting a second claim for the other 500 pounds
I'm fairly new to this too, but apparently yes you can only go back 5 years in Scotland for your claim.
If you have a look at the templates bitty which is up at the top of the forum page, there is an itemised list of the procedure regarding your preliminary and letter before action etc.
For your third point can I suggest that you look at both my and Alpha's thread for what seems to be the best way round this.
