Hope I'm doing this right. Sent a letter using the MSE template requesting list of charges or statements on 2nd April 2006. First big mistake, didn't send it recorded delivery. As I sent my son's at the same time and he also banks with A&L, I didn't make a note of which cheque was sent with which letter (second big mistake). On 23rd April one of the cheques was cashed, but I have no idea which account they are processing, so I give them a little phone call on Bank holiday Monday, only to be told that there is no record on my file to say that it is my account that is being processed. Ah Ha....I think....it must be my son's account that they have cashed the cheque for. So I get my son to phone them, and guess what, no there is no note on his file either. I can't speak to the department dealing with the claims as they are not customer facing and nobody seems to be able to tell me what has happened to the other cheque and whether both of our requests are being dealt with.
So, I sent them a letter from each of us (recorded delivery this time), stating that as they have cashed the cheque on 23rd April (as I can't prove they received it at the beginning of April and to whose account the cheque is relevant) and therefore, to show reason, I will give them until 28th May before reporting them to the Information Commissioner and also make a claim for the maximum amount under the small claims track. Not sure now whether this was a good idea, but I read somewhere that somebody else had done the same and then amended the amount of the claim later. I'm not sure that this will stack up and I'm getting more than a little frustrated with them. Be grateful for any advice on how I can wrench this information from them

For what it's worth, Russjo, I think you did the right thing. It has put the ball in their court, they now have to chase up the records on both accounts and reply to you - so at least you'll know which account has been actioned.

Sorry, but I'm not sure myself. I think they are talking about interest they have been charged whilst overdrawn. I haven't been including this on other claims that I have been doing for my family as I thought it was only statutory interest that you include :?

Yes, you can include these in your claim. I think they sometimes get overlooked because the amounts can seem insignificant compared to the penalty charges themselves.
Hope you're around Youngandfree, if not, can anybody else help. After sending the letter threatening them with court action if they didn't send me my statements (and my son's), "Bob's your uncle" they all turned up yesterday, lovely surprise. So I busily sat last night into the early hours, totting up the amounts which come to £3979 for me and £1273.50 for my son. However, I'm just typing up the letters and I just need to triple check that we are able to claim back the "overdraft interest" but not the "monthly interest". I've made a few fumbles with some of the letters previously and I want to make sure that I get this right

Okay I've posted the prelim letters. I'm claiming just over £4k and £1250 for my son. So they've got 14 days. Also has anyone read the BBC News page about A&L having to make an apology for the letters they've been sending out. All I can say is Ha Ha Ha

Hi Russjo,
If you want to make a claim for overdraft interest (as well as the 8% on the charges themselves) you should consider using the complex spreadsheet instead of the simple one - it will do both for you. Of course this is only operable if you actually have to start court action, but that's a few days down the line for you yet, 14 days after your lba.
Use the time to read up on procedures - it'll pay in the long run - believe me - I've just had an offer of payment in full!

I've tried clicking on all spreadsheets and I can't seem to get them to work. I used the spreadsheet from MSE, but I must admit I've deserted that site as there are a lot of people passing judgement on others and not much being done about it. I would much rather use anything connected to CAG instead so if you've got any pointers I'd be grateful

Received a letter from A&L today. Pretty quick really because they didn't receive it until 29th May, however, I know that this process is not going to be as quick in comparison. Usual blurb in the letter, so will wait until the 14 days is up which is not until next week and then will send them the next letter. The waiting game is killing me

Interesting. I'm claiming on behalf of my son with A&L and sent identical prelim letters for both of us. The only difference was the amounts that were being claimed back. I got a letter telling me to bog off and he get's a letter saying we are looking into your complaint. There seems to be no rhyme or reason to how they handle things. Well there's definitely rhyme and reason in my house, because they are going to get the next letter shortly and see what happens then!
