Hi,
Both myself and my wife have sent the initial standard letter, along with £10 covering charge, to our respective banks.
I've heard nothing from mine, but today the wife received a letter from Barclays (recorded delivery!) returning her fee and informing her that they "do not offer this facility".
Is this a breach of the DPA? Does she now report them to the Information Commisioner's Office? Sorry, I have looked in the FAQ, but it this particular step didn't seem that clear to me.

Yes it is a breech of the DPA .write back to them , recorded delivery ,stating they are in breech of the DPA and giving them a further 7 days state in it that if they do not comply that you will be reporting them to the informaton commissioner and starting a claim against them for compliance.
If you use the search facility of the site you will find others have been in a similar situation and there will be copies of detailed letters that may be of use to you.

She sent the letter to the following address:

I haven't actually read the reply myself yet (she called me earlier and told me about it), but could it be that they simply didn't offer the facility from that particular address? Reckon I might get her to send a letter to her local branch, then take it from there.

Sounds very much like a stalling technique....I dont think its anything to do with the Branch having no facilities.....their computers are networked I am sure of that.
Send the 7 day letter out stating their breach using the letters temp.
Enclose the tenner again and send it by either recorded or special.
The person handling your request obviously has little idea of the DPA or its implications for non compliance.
Maybe you can educate them as to that.

Their letter said that they couldn't provide the data in the format requested (ie: a list of charges). Strange, as the standard letter she sent made it clear that six years of statements would be acceptable if that was the case.
The wife called them, explained this slowly and carefully to them, and they have now agreed to send the statements.
