    Default backup fund for people taking banks to court

    Hi all,
    I am taking on a bank to the tune of £8,200. Natually with the latest developments, I am a little more on edge than I would like to be. Not a problem, onwards and upwards.
    What I would like to set up for people like myself who are not going to be in the small claims court, is a pledge fund as a backup in case anyone does lose a case (no likely, but alway eest to be safe). If we all pledge a little money, we can keep the ball rolling nicely. I am pledging £20 now, anyone care to join me

    Hi Magnusman

    This is a lovely idea, however as most cases are settled out of court the fund would not be needed. Also as most cases are under the £5000 and are allocated into the small claims court there is very little chance of costs being awarded against the claimant.

    It is an idea that has been bandied around the site many times, mainly in the mortgageicon section as this, we have found, carries the most risk. However it is something that would be hard to adminster. It would take up a lot of time and as we are made up of mostly volunteers question of security would raise its head at one time or another, as that is life I am afraid.

    I do see that this could be logiically difficult, but if someone does lose out to the banks, it would make news. It would then be up to the people who have pledged to keep to their promise. The problem comes from controling the amount so that an individual does not make a small fortune. There is always a way. Would welcome some other like minds putting their heads together.
