Not posted before but have been lurking for a few months, so I guess it's about time I said "thanks!" for all the helpfull advice on here I've been in the process of claiming back £1500 back from Natwest and following them not responding to any of my letters I went down the MCO route. A few days after this I received a full settlement offer from them that I accepted. My question is: Should I wait until the money is in my account before closing the claim and how long does it usually take from accepting an offer to the money being in your account? Also, due to how quickly I received my offer following applying with MCO I'm wondering that they have made the offer prior to being served with the court papers. If this is the case, is this likely to cause any problems?
If the offer was after you filed through MCOL-then the only consideration is that you have incurred an extra cost that is up to you of whether you claim this or not.
If you have accepted their offer in writing - then do not close your claim untill the money that is agreed to be paid is paid in full.
You did have a choice at that stage to reject their offer - on the basis you can pursue the court amounts and 8% but if you have accepted it in writing, then this is no longer claimable unless they do not stick to their side and break the letter of agreement.
Did they give you a date of when the money was to be paid in?
This would then be the decision of whether you would reject the offer - based on them breaking terms agreed - or you could be patient and give them a call to remind them you have a claim that you will pursue till monies received in full and pursue the court costs unless paid within 7 days.
Yeah, I think I will try and claim back court fees once I have the money in my acc. They've given no date for the money to be paid into my account, why should they have?
I called Natwest to confirm that they've received my acceptence and was told that since they issued the offer before they received notification of my court claim, they would not transfer the money into my account until the claim was dismissed. I was led to believe that a claim should not be stopped until the money is in my account, can someone please give me advice on what I should do?
I would continue with the claim and also ask for 8% statutory interest.......they had the chance to pay........dont stop the claim until u have recieved the cleared funds.......explain to them that they either pay you the money + court fees and u will cease with the court claim OR continue and get the extra 8% in my opinion u should keep going until u get whatever figure u r happy with........
They will pay out so its up to u........
But do not stop any court action until u get the money
Thanks for everyone's help, I've spoken to Natwest again to tell them I wouldn't be stopping the claim until the money had cleared in my account and they said that was fine this time :S It's so annoying that they just seem to be telling people any old crap, I could swear I spoke to the same person too...
Always get a persons name in any phone communication. They tend to be accurate in thier answers if they think there is a comeback to them. Well done for sticking to your point of not stopping proceedings until funds had cleared.
