Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Hi there, I've just successfully claimed back over £3000 from Natwest - Happy days! However, as I owe them £1500 for a loan and. However, as they will still owe me the rest of the money, I was told today by Unidebt (Who are now handling the accoount) that I will have to wait ten days after the the charges been paid back because the account is now closed and they need to make sure that nothing else is owed (which it isn't)
Can they legally hold on the money for ten days after the charges have been back? (Even though I owe them nothing else!).
It sounds like to me that this is a delaying tactic.
Hi.. I had the same problem last week, when i went to draw the funds out of my Natwest account they informed me i could not have it as Telford wanted to clear my debt (they had already taken this off the balance) and would send me another cheque for the remainder in 10 days!
I asked the branch to put me through on the phone to Telford who dug their heels in more and told me there was nothing i could do, the new cheque would be with me in 10 days! I told them then to shove their settlement, and stormed out of the branch!
I returned home and phoned Cobbetts who seemed more upset than I that this had happened. She told me Natwest would call me soon, I got a telephone call from Head office a few hours later saying sorry and i could go down to the branch again and my money was waiting and also to bring the uncleared cheque for the aq fee as they would clear this straight away for me!
Result! .. sometimes it's worth stamping your feet
Sorry I don't think so, my case went right to the wire and they wanted the Notice of Discontinuance. It looks like your going to have to wait a few more days
I know it is frustrating but you still won
Does anyone else know if legally they keep can the money for 10 days? Could I say to them that I could take further legal action if they don't release the funds within 24 hours?
Ok - the ten days past on 28th May. Was promised that the cheque would be with me by today, but hasn't arrived yet. I called on 29th to see what's happening and was told if it didn't arrive by today, call them and they will release the cash over a counter at a branch. I called them today to arrange and they denied all knowledge of it, and they've told me that I just have to wait for the cheque!! Iwent totally mad at them and said they have no right to keep this money as it's rightfully mine.
hi there, just guessing but how about another letter before action ? anyone got any other ideas

Gary, PM Parkvale - he's one of our site helpers now. He'll either know what to do or know where you can get further advice.
Good luck mate - hedgey xxx
p.s., and for its worth, I think this really stinks. They're giving you the runaround and they're out of order. Classic case of the left hand doesn't know what the right hand's doing.
Lol......... you need to click on Parkvale's user name (he posted on Fendy's thread this morning so he'll be easy to find!) and then send him a private message. He's not online at the moment though - but he'll probs be back on this afternoon. Hope he can help you with this. xxx
hi there. im new to this. I have an overdraft with my bank. I was told if I try to claim back charges they could just ask for me to repay my student overdraft which i dont have the money for? should i proceed?

The first thing you should do is start your own thread here is the link to do that. http://www.consumeractiongroup.co.uk...newthread&f=12 But to answer your question. You need to open a parachute account first then start your claim. once your claim starts your account is then in dispute so they can't or are not allowed to close it...Start your own thread and you will get loads of helpful advice.
Good Luck

Thanks for this - But it doesn't answer my question. All Unidebt are doing is holding rest of the money that they owe me of the loan was paid back. I'm wondering if I should now file a court order to get the meny back?
