Hi all can any one advise what is the best course of action. We are being hassled by Call Serve Ltd we have had home visits by a local agent I told him to tell Abbey to stick it up there #### they are claiming £734.52 this is made up of there bank charges as we have paid back the overdraft, they have defaulted the account and closed it. we are at present claiming back our bank charges which with interest amounts to £6000 what happens with this situation shall we pay them back when we have claimed our charges.
Call serve are also representing Cahoot for a loan amount of £8245.34 I unfortunatly lost my job and have been trying to get back into full time employment should I CCA them ?
for the Abbey issue, if you write to them, disputing the oustanding amount, I am sure that they cannot put a default against you, secondly, seeing as the agreement has been terminated by them (closing your account) they have no legal right to process your personell data unless it is a ccj etc, I had a similar problem with Abbey, I told them that, if they prove the outstanding charges were proportianate to their loses I would pay them, or if they preferred I could pay them and take them to court to reclaim them, 8 weeks down the line, it appears they are going to refund the charges (just awaiting conformation).
on the second issue, tell them you will no longer discuss the issue over the phone, you will only discuss it in writting from now on, don't take any rubbish from them hang up. When you get a letter from them do a CCA request
Thanks Strangewayofsavin Abbey have already defaulted the account this has affected my Wife's own personal account as they will not issue her with a new check book with out going through another credit check obviously something has been flagged My wife has been with the abbey for 25 years it really is awful, what letter did you write to them did you get it from the template section .
