    Unhappy Barclays - I think its all going "Pete Tong"

    Hi there, I was just wondering if there was anyone out there that could give me a bit of advice! I'm at step 9 on my way to claiming my fees back from Barclaysicon, I've got the Notice of Allocation to the Small Claims Track letter from the court. This was dated 29th March 2007, my court hearing date is set for 27th June 2007 at 10am. What I have just got myself in a right old tizz about is the fact that I have just pulled together all my letters etc and seen that it says I was suppose to file full particulars of the accout to Court by 4pm on 2nd April!!!!!!!!!

    The Notice was dated 29th March, it would therefore been at least the Friday 30th March before I received it and not until after 6pm when I got back from work - there was then a weekend - and then I was suppose to file particulars with Court before 4pm on Monday 2nd April. I have obviously missed this date - is it still too late to send in my particulars of the account into court?? I thought I was to receive a "court bundle" or something, thats why I havent done anything until now. Does this ****-up on my part mean that I've ruined all chances of getting my day in court and any chance of getting my money back - I cant believe how slack I've been, not that I would have been able to get anything done in 2 days.

    Just for clarification I'll copy what it says on the letter:

    1. The hearing of the claim will take place at 10am on 27th June 2007 at Bradford county courticon, and should take no longer than 1 hour 30 mins.

    2. The Claimant shall by 4pm on 2nd April file with the Court and serve on the Defendant full particulars of the account or accounts to which the claim relates and in respect of each account he shall specify the amount of the charge complained of and to date or was debited to his account. (this is what I've not done!)

    3. The defendant shall within 14 days of receiving a copy of the Claimants particulars provided for in para 2 above file with the Court and serve on the Claimant a counter-schedule specifying how each item of charge on the claimants list has been calculated

    4. This matter is listed for hearing on 27th June at 10am blah blah blah

    5. Not less than 14 days before the hearing all the parties shall serve on each other and file with the court copies of all documents on which they rely at the hearing. Such documents shall include the written statements off all witnesses upon whom either party intends to rely.

    I'm so cross with myself at the moment, I obviously didnt read and digest it properly when it came through the post and now I fear that I've lost the only chance I had to get any money back - are Barclays sat laughing at me now or is there anything I can salvage from this mess?????


    I knew that I had some work to do but I thought this was sending in the papers to the Court 2 weeks before the hearing date - not 2 days after I received the letter?!?!?!?!?! What am I going to do???????

    It looks like a clear typoicon to me - call the court and ask them what teh date should have been and ask them to reissue
