    Cool Fat Controller v Barclaycard

    It will take you ages for you to get them. Get your letter ready because you will not get the statements before the 40 day timescale. You have to threaten them with a court again.

    I received the following letter from B'card today in response to my SARicon from the templates libraryicon. They returned my SAR and the £10 fee.

    Dear.......

    Further to your request for personal dataicon held by Barclaycard.

    Unfortunately we are unable to provide you with information you have requested as it has been deleted from our main computer systems and therefore will not be available.

    If the purpose of your request for statements was to calculate and reclaim the fees you may have paid in excess of the Office of Fair Trading limit, please write to B'card customer relations at the following address and enclose a copy of this letter:

    Could someone advise me on what the legal position is with regard to keeping data. The account was only closed in 2003.

    Is this a standard response and have others had this letter or similar?

    I thought that by law they were supposed to keep 6 yearsicon of data. I am very surprised.

    I will write back with a non compliance letter and remind them the clock is still running.

    I thought B'Card would have got the message since the ICO ruled against their microfiche [problem]. Perhaps they just stall with everyone now?

    i am having same probs as u with baclaycard, account was closed 2005 and they have seem to have deleted all my details, wonder if i owed them money would they 4 get about it, its my money and i want it back

    I would have thought they had got the message after I forced them to to cough up £200 damages last week...

    When their 40 days are up, complain to the ICO using the form on their website. Then take them to court.

    You could ring or email Adrian Ruffhead reminding him of his humiliating climbdown in case number 07/016920.

    Having had my SARicon refused on the microfiche [problem] I emailed Natalie Page at Barclaycard. She was quick to respond and very polite but just passed on my request " to the relevant department" !!!!

    Got my statements today (26 days) going back to May 2001.

    I closed the account in 2003 and unfortunately it seems that all of the charges were before May 2001 but without these statements I can't claim them back.

    Looks like I will have to forget about B'Card and concentrate on my other claims.
