I opened a bank account with Barclays in 1996 at the recommendation of my wife. Subsequently when we bought our first property, took out a mortgage with Barclays along with and endowment policy with Barclaylife. I have been a faithful and compliant customer through all these years. Wife stopped working with the regular arrival of kids and with rising expenditures and diminishing earnings, the dreaded £30 fine letters also started raining through the letterbox. I know I am to blame for financial mis-management but £30 is well over the top. They have been deducting these charges regularly for at least 8 years now. I pay at least £60 pounds every month towards these charges. On the other hand I have huge credit card loans with Barclaycards amounting to £16000. I keep up to that with my credit card payments but o/d keeps on crossing the limit of £2420. Sometimes as little as £5 incurs a fine of £30. I am fed up of all this. There seems to be no way out of it.
I have these questions:
i) If I sue Barclays Bank to pay back these deductions, along with interest, would Barclaycard shut down my account demanding an immediate payment for £16000?
ii) Most people seem to be asking the banks for data from previous 6 years. My suffering goes beyond that. Can I ask for statements going back 10 years?
iii) Would Barclays Bank shut down my account demanding the immediate repayment of the £2420 over draft I owe them?
iV) I get free legal help from my union at work (Communications Workers Union), would it be any help if I get the union solicitors involved in this case?
