I'm about to send a CCA request to RBS re a credit card that I have not yet defaulted on, but I am behind with payments on it.
Should I still add the bit on my letter about not acknowleging the debt to their company?
I'm concerned that if I do add that bit, and they CAN provide the CCA, then they will be pretty peed off, and won't be happy to play ball when I offer to pay them a token payment each month!
Would be great to hear what you think, as I have the letter ready to send, but it's been bugging me all weekend!
hi there,ive cca d r.b.s and i didnt mention not acknowleging the debt,i dont think you need to bother with that until they fail to produce the cca,you dont have to give a reason why you want the cca its their statutory obligation to provide it when requested!remember to send a postal order not a cheque and send it recorded

Hi, yes that's right Jezzy, although I did send a cheque on my OH's behalf signed by me and got reply back from Citi that they haven't got the agreement so have now sent the bit that you asked about. Template letter re cca and SAR in Creditors and DCA's templates sticky. Don't forget to make a note of the date they received it, print it from Royal Mail site track & trace
and then do the countdown 12 + 2 for the cca and 40 days total for the SAR.
Not too sure on that one myself, but we are saying when the pests telephone that the account is in dispute, don't give them any other information than that no matter how hard they press!

Do you think it's only worth adding the 'don't acknowledge any debt with your company' bit only when it's a DCA sending you letters? i.e. not the original creditor?
I'm also CCA'ing Next, and don't know whether or not to re-do that letter
No, I wouldn't say "not acknowledging debt" at this stage. What I would say is that "this account is in dispute" - that will buy you time & see what they come up with
