Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I think it may mean they have put in a defence, I know it says 28 days but it seems to stretch for some reason. Ring Northampton tomorrow and see what they say.
ok just checked the full court thing again and it says, request for judgement and reply to admission, also says defendent admits all monies is owed, ive already got the defence papers, it seems to be asking me how i want it paid, surely it cant be that easy
looked at this judgement again.... says status halted.... then there is a box ticked next to defendent admits alll money is owed.....then a box to tick (i presume for me) which says i accept proposal for payment or defendent has not made proposal for payment. as far as i,m aware they have not made proposal for payment. which do i tick??? or do i tick any???. Then says judgement details.. this asks if i would like to be paid immediately or by installments and in full by which date?? It does say amount claimed £3556.90 plus £120 court fees however the subtotal is blank. Anyone had the same kind of thing. Any advice appreciated
Since you have not been onformed by the bank, you should tick the applicable option to it - "defendent has not made proposal for payment"
Pay immediately and allow 7 days max.

Why, Jonni said to tick the box defendant has not made proposal for payment, the bank has not been in touch with you have they?
So you tick the box and ask for payment immediately. Give them 7 days if you have not received your money by then. you will get judgement by default I think.
They have only 28 days from the date your claim was served, to defend, if it has gone over the 28 days then it is your right to do as it says on MCOL to ask for judgement, if the bank has over looked or forgotten to defend it is not your problem.
Does it say defended on the MCOL, in the boxes at the bottom it says served, acknowledged and then in the next box it should say defended if not they have not!
wont let me do that, so it does not say defended on MCOL, however i have had papers from solicitors to say they will defend, MCOL says judgement halted and status of claim does not allow me to continue with judgement (08/05/07) on the MCOL form box b is ticked which says defendant admits that all money is owed.
