    Default KJD v Barclaycard **WON**

Having just started with Lloydsicon, I thought I'd tackle my Barclaycard.

I haven't many problems with them recently as paid by direct debiticon but before that I used to pay by internet banking and more often than not, payments made a few days late! Due to Lloyds taking more charges this month, my d/d to B/card got bounced and they've called me this week, talking to me like I'm a criminal! Now have a letter with a £12.00 charge being applied. Red...rag...bull...

DPA letter typed up and ready to go first thing in the morning

This morning received reply to SARicon from Barclaycard. Statements from June 2004. They say prior to this they are on microfiche but will get to me within the next 6 weeks or so. Also says that they do not consider that m'f statements fall within the scope of the DPA 1998. But supplying them as a gesture of goodwillicon! Yeh, whatever!

Quick glance through what they've sent. Only £96.00 charges so far (late payment), but for most of that period I have been paying by direct debiticon so payments were on time. The statements on microfiche will show a different story I think!

They know that there is a power somewhere so organised, so subtle, so watchful, so interlocked, so complete, so pervasive, that they had better not speak above their breath when they speak in condemnation of it."

Is Barclaycard the only bank to fob us off with this microfiche nonsence?

I am so not looking forward to dealing with Barclaysicon

I think Abbeyicon were the only other ones that use it so don't worry too much about any others. My very 1st letter to Barclaycard was 22nd Feb and only now on the verge of filing my court claim.

    Nightmare but keep with it

    They are such wags!

Their letter says that "statement requests are being dealt with in the order they come in to ensure fairness. The Data Protection regulator, the ICO, has been made aware of the position and knows that we are writing to you in these terms."

Ooh, moneyhelp, can I have one of your debit cards?

Where has all the time gone????

It's nearly a year since I started this thread and tbh I haven't gotten any further with Barclaycard. However was having a sort out today and came across the copy statements BC eventually sent me. So am back on track now...

I'll have to have a read around the site again to get myself up to speed on how the land lies now re claiming back these charges (all late payment fees except one). Total is £491.00 to be reclaimed.

Will come back and holler if I need help - hope that's okay!

    Hi KJD,

Claiming back chgs from BC is now simpler than a year ago.

Also, and more importantly, you have a better chance of claiming CI if you get your claim right from the start.

Revise a bit to get back to speed with us, update your SOC to include any recent penalty charges and let us know what the claim total is.

Also have a read here about CI - http://www.shweb.pwp.blueyonder.co.u...20tutorial.doc

Have a look at the spreadsheet link in the Credit Card para.

Sent off prelim letter claiming £519.00 (no interesticon applied yet). No response.

Then got my statement last week and they have credited my account with £167.00 - 'Refund Late Charge'. It has just appeared, no letter of explanation.

I think there is a letter on the site which basically says thanks very much but where's the rest! So am going to send that unless anyone tells me not to.

Letter from Barclaycard today.. (I hadn't even gotten round to checking to see if they'd received it yet!)

    "Sorry you feel etc etc.

Please have another £363.28 (a bit more than I'd asked for but am not complaining!)

However, we believe that our charges are fair and reasonable."

    So, result guys!

A big thanks to all who helped.

    Hi Karen,

Delighted to hear this and Congratulations

If you can make a site donationicon, it will help others.

It may be that BC have made a full refund plus a flat 8% bonus. It's not as much as the 8% s.69 interesticon you could have claimed if you'd filed at court, but better than no int't at all.

Sorry, Bookie - sketchy is my middle name lol!

I sent them a prelim letter dated 22nd July 2008 asking for £519.00
(Then was away for a bit)
Refund 'appeared' on my August statement for £167.00
Sent refusal of offer letter on 1st September 2008
Received letter dated 3rd September 2008 saying that £363.28 will also be credited to my account.
I don't use my card any more but this refund has almost cleared the balance.

Didn't even get to lbaicon stage.

Re-reading the letter they sent, they have added 8% which accounts for the difference in my / their figures.

It was all so easy I almost wish I had charges on my other cards! Just Lloydsicon bank account to be sorted now.

I have donated a bit to the site, but not as much as I ought to I think. Will send a bit more when wages come in.
