Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Having just started with Lloyds, I thought I'd tackle my Barclaycard.
I haven't many problems with them recently as paid by direct debit but before that I used to pay by internet banking and more often than not, payments made a few days late! Due to Lloyds taking more charges this month, my d/d to B/card got bounced and they've called me this week, talking to me like I'm a criminal! Now have a letter with a £12.00 charge being applied. Red...rag...bull...
DPA letter typed up and ready to go first thing in the morning
This morning received reply to SAR from Barclaycard. Statements from June 2004. They say prior to this they are on microfiche but will get to me within the next 6 weeks or so. Also says that they do not consider that m'f statements fall within the scope of the DPA 1998. But supplying them as a gesture of goodwill! Yeh, whatever!
Quick glance through what they've sent. Only £96.00 charges so far (late payment), but for most of that period I have been paying by direct debit so payments were on time. The statements on microfiche will show a different story I think!
"Some of the biggest men in the United States, in the field of commerce and manufacturing, are afraid of something.
They know that there is a power somewhere so organised, so subtle, so watchful, so interlocked, so complete, so pervasive, that they had better not speak above their breath when they speak in condemnation of it."

Change the US for the U K... do you think he meant CAG?!
I think Abbey were the only other ones that use it so don't worry too much about any others. My very 1st letter to Barclaycard was 22nd Feb and only now on the verge of filing my court claim.
Their letter says that "statement requests are being dealt with in the order they come in to ensure fairness. The Data Protection regulator, the ICO, has been made aware of the position and knows that we are writing to you in these terms."
Am at the lba stage with Lloyds Bank - I feel like Queen Boadicea!!
Ooh, moneyhelp, can I have one of your debit cards?

It's nearly a year since I started this thread and tbh I haven't gotten any further with Barclaycard. However was having a sort out today and came across the copy statements BC eventually sent me. So am back on track now...
I'll have to have a read around the site again to get myself up to speed on how the land lies now re claiming back these charges (all late payment fees except one). Total is £491.00 to be reclaimed.
Will come back and holler if I need help - hope that's okay!

Sent off prelim letter claiming £519.00 (no interest applied yet). No response.
Then got my statement last week and they have credited my account with £167.00 - 'Refund Late Charge'. It has just appeared, no letter of explanation.
I think there is a letter on the site which basically says thanks very much but where's the rest! So am going to send that unless anyone tells me not to.

Letter from Barclaycard today.. (I hadn't even gotten round to checking to see if they'd received it yet!)
"Sorry you feel etc etc.
Please have another £363.28 (a bit more than I'd asked for but am not complaining!)
However, we believe that our charges are fair and reasonable."
So, result guys!
A big thanks to all who helped.

If you can make a site donation, it will help others.
It may be that BC have made a full refund plus a flat 8% bonus. It's not as much as the 8% s.69 interest you could have claimed if you'd filed at court, but better than no int't at all.

I sent them a prelim letter dated 22nd July 2008 asking for £519.00
(Then was away for a bit)
Refund 'appeared' on my August statement for £167.00
Sent refusal of offer letter on 1st September 2008
Received letter dated 3rd September 2008 saying that £363.28 will also be credited to my account.
I don't use my card any more but this refund has almost cleared the balance.
Re-reading the letter they sent, they have added 8% which accounts for the difference in my / their figures.
It was all so easy I almost wish I had charges on my other cards! Just Lloyds bank account to be sorted now.
I have donated a bit to the site, but not as much as I ought to I think. Will send a bit more when wages come in.
