I am at "Further Particulars" stage with RBS via Cobbetts.
My claim is for +-£2000 and I also received the intimidating "bully boy" documentation threatening to have the claim struck-out if proper particulars are not filed.
RBS seems to be adopting an expensive tactic of delaying actions for as long as possible in the hope that the OFT will come up with a charging scale which they can set-off.
My response to Cobbetts has been just as aggressive as their request was.
Hopefully they will apply to Court for particulars and I will at least get RBS before the Court. But I suspect that they will apply to Court knowing that the hearing date for the application will be weeks or months ahead and further delay our day in Court.
My only hope is that a Judge will see through their ploy, set a quick date and then dismiss their claim. If he agrees with them then he will order me to supply further particulars or strike out my claim. If he/she agrees that they are not behaving properly he can make a special order as to costs.
im just about to get to the end of the 28 days and am expecting a defence through the post from solisters, its horrible that they are trying to delay in given money back to people who they have stolen. im pleased im moving every thing from them, i hope that when i get to the stage of going to court which should be quick as im in wales, i get all my money that they have taken from me
