    Thumbs up Slim69 -v- The Woolwich

    Hi y'all. Although I signed up some time ago it has taken me until now to finally try to get this claim on the road. I went through my statements last night but unfortunately have some missing (oh how I was looking forward to having them all - but thats life). Can someone let me know, whether I can claim beyond the 6 yearsicon? and if so, it is better to claim in one go or break them down in £5,000 claims? Looking forward to your responses.

    Does anyone know what is the current response time once you send the S.A.R - (Subject access requesticon) to the Woolwich? I sent mine by recorded delivery last week Saturday (12/5)

    Hi Slim

    They seem to be just getting in around the 40 day mark even though the standard response blurb letter they send out to acknowledge your request will state a date that is usually a calendar month from the date they write...ignore this and just stick to giving them 40 days + 2 days (for your friendly postman). If it's not landed on your doorstep on day 42, send the next letter - lbaicon for DPA breach.

    There's lots of info about the pre 6yrs rule but I haven't read. I think the general feel is to break them up, seeking the 2001-2007 first.

    I got home last night to find a Schedule of charges from The Woolwich. Now the amount the shown on the cannot go through small claims. I am in the process of typing up the schedule to include interesticon charges once I have done that I will be send my request to them.

    I am quite surprised that they have responded so quickly I haven't had a chance to look through the website properly.

    I am intended to make a full claim rather than in £5,000 purportions. Has anyone done this and been successful?

    Quite a few on here have successfully gone for the £5k + sum in one go so you'll find plenty of experience on the site.

    Barclaysicon t/a Woolwich don't appear to be following any set pattern for discriminating between snail pace block all the way -v- making an offer early on in case (unless perhaps it is influenced by whether or not claimant is still an attractive customer).

    My claim is well over the 5K, and I have been told by my court that it would be allocated to the Small Claims. I don't know or have read anyone going to the Fast Track as yet. You don't have to worry about it yet not until the aqicon stage. Best of luck

    I'm new to CAGicon. I have a £3.5k claim against the Woolwich that I submitted via MOC. This has now reached the defendant (Woolwich) submitting their defence. I am waiting for a communication from the local court. Has anyone reach this stage? what should I expect? and any advice on preparation for the court?

    The Good thing about this is that Barclaysicon HAVE to disclose how much the charges are, and they do not want to do this, so they will settle before court date. The bad I have read that it could take longer for a court date, have your court given you a date yet. Have Barclay's offered a defence yet, if so you will get a Allocation Questionaire, from this point you should get a court date.

    Let me know the exact stage you are at, so that I know what stage is next.

    thank you for replyin to me, i have recieved a letter titled general form of judgement or order and it states that the judge has considered the case and ordered that the claim is allocated to fast track, the action is stayed untill 6.7.07 and me and the bank are to talk, by 4pm on the 20.7.07 we both have to file a report, it does state that because this order has been made by the courtwithout representation from either party we both have the right to apply to have the order set asideicon, varied or stayed i have not been given a allocation questionaire, or been asked to pay anymore money

    Sounds really legal, however give Barclaysicon a call to see what their response will be. I'm sure you will be told that they will settle 2-3 weeks before court date (I was) refunding full chagres with 8% interesticon and court costs. You will find the various numbers on my thread. You can all but try. Let me know the outcome.

    With Woolwich apparently switching over permanently to Barclaysicon on 20/7 (new account details not yet received), who do I send my lbaicon to. I have been fighting with my schedule for nearly a month now and just want to get it off. The principle amount is correct but the interesticon can be different from one day to the next. I would prefer to send this by email as with a busy little one and work commitments I may drag my heels to send it by recorded deliver.

    I received my schedule from a Carla Rundle from Openplan. Has anyone had any dealings with her?

    Congratulations to all who have been successful in their claim in the last couple of months.

    Wow I have now had a response from Barclaysicon (not bad for email them on Sunday night/Monday morning). The have made a goodwill gestureicon of just over half my claim. Of course I am not happy with that and wondered if at this stage anyone has experience of asking for a schedule of charges either side of the period they are claiming.

    What I would like to do is assess those figures first before making them an offer.

    Hi Slim

    Why would you make them an offer? Surely you want all your money back so will be sending a rejection offer (in which you accept the GOGW as part payment only).

    If they have added more charges since you sent your Preliminary Letter, just send an update Schedule of Charges with your rejection letter.

    Truth is Slim, Woolwich are not going to turn around and make this easy for you by caving in and refunded the full amount so why would you want to make an 'offer'? It is all your money, you don't have to try and negotiate with them to try and get a good deal - you take them to court and get it all back!

    Don't delay in sending back the rejection (partial payment acceptance) and don't delay in following up with lbaicon which I suspect is about due now.

    Don't combine the two - send them seperately and both registered.

    Only once you file a claim with the court can you add the 8% remember
