    Hello All

    This is my first post here...am looking for any useful pointers.

    Have MBNAicon Visa card and MBNA Mastercard..both cards were on relatively normal rates ( 15.9 and 17.9 ) and then around Sept 06 and Nov 06 without notice MBNA increased the rates to 24.9 and 27.9 respectiveley.

    Spoke to MBNA and they advised me that this was due to a review of my account, though they admitted that thousands of their customers had had their rates increased following the review...incidently my credit file was no different after the increase in APR compared with when the rates were lower. MBNA adviser suggested the increase was down to increase in risk..although there would appear to be nothing discernable to show that i was any more of a risk than i was when i first took out the cards.

    ( incidently MBNA maintain that they notified me of increase on both occasions..and that they cannot be held responcible for non performance of the Royal Mail )

    have never missed a payment..no adverse on my file etc etc..

    Anyway..sorry if this a bit long...have asked MBNA for a copy of all my documentation under the Data Protection Act..they have supplied a batch of papers that are hard to understand ( screen prints etc ), but they have failed to provide copies of my statements ( which i specifically asked for ), and there are no copies of letters advising me of an increase. In addition to this, some of the screen prints appear to have been doctored with black ink to prevent me from reading what is underneath.

    My view is that as they have not provided me with evidence that they have notified me of the increase to the APR, they are in breach of their terms and conditionsicon.

    I have also noticed that on some occasions they have taken payment from my bank on different dates (also without notifying me ).

    My balance some months seems to be higher than on previous months..i have asked for an explanation but am given the usual waffle about paying the minimum payment. My minimum payment also increases sometimes despite the APR not increasing any further.

    My feeling is that somewhere in this mess there is proof that they are engaging in Unfair trading practices....

    I am considering contacting the financial Ombudsmanicon, as i have already complained through the trade body, and MBNA have said they will not discuss the matter further without the Financial Ombudsman service involvement.

    I am also considering contacting the Information Commissioner as i think they have failed to comply fully with the Data Protection Act.

    Does anyone have any ideas that may assist me in this matter..am also considering taking matter to the small claims court..

    Any thoughts or ideas would be greatfully recieved..

    I am running out of my own litigation details with MBNAicon and Capital Oneicon.

    As my family and I are surviving on DSS benefits and have tried responsibly and reasonably to deal with our creditors, the ensuing responses from them and the authoratitive bodies have absolutely disgraced me, and now that it is to the detriment of myself and my family, I feel obliged to go to a solicitor and my local MP to take these people on.
