Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I sent the Woolwich a letter on 23 March asking for a list of my bank charges or statements for the last 6 years. I had a letter back saying I would hear by 24th April. Guess what......... So I rang them on 2 May and they said they would come back to me. Has anyone else had this problem in just trying to get my list of charges. I read on this forum that email was the best route with Woolwich. Has anyone got the address.
I've just had to MCOL file against Barclays today for a DPA breach (they've had 60 days now and have told porkies in emails about having sent 1st class post blah blah).
I also reported them online to the ICO (this is free) and had a nice letter back stating that there are so many complaints being received about Barclays that ICO now batches them all up and writes to the banks once a month citing all the complaints in one go.
Finally got an answer from Woolwich. They haven't sent me my statements but a list of charges. How do I know this is correct? I sent them an email complaining that I had not heard anything and by return post received a list of charges totalling £2,411.50. Is it worth sending them an email AGAIN asking for the amount as it seemed to work before or shall I send them the letter
they send a list of charges and most people seem happy to accept that the figure is correct, on the assumption that were the woolwich to lie about the amount they would be in deep trouble, I had a list for £2,400 which was about what i had estimated so was happy with the figure ,they sent, i also had an offer of £1900 along with the charges

Barclaycard S.A.R - (Subject Access Request) sent
Halifax SAR sent
Citibank Sar sent - blah letter sent back. sending a SAR default notice at end of 40days
Capital one SAR sent, statements recd, 14 day letter sent
I received the same type of list Total £1,746.00 over 6 year period but as they don't send copies of statements they did not charge for this information. I did have some old statements going back to 2004 and the charges did correspond with the list.
Hmmm interesting that the list of charges don't match your statements, ouger. It's what I suspected when I got my list.
One thing that providing the list of charges only prevents is any of us claiming back the interest on the charges that the Woolwich have levied. We need a list of all transactions too in order to work this out.
I've sent them a non-compliance with the DPA letter reminding them that I originally requested a list of transactions, as well as charges. Not a sausage back and they well over the 40 days.
WOOLWICH -S.A.R - (Subject Access Request) sent 03/03/07 LBA sent for non-compliance with Data Protection Act 28/04/07
ABBEY - S.A.R - (Subject Access Request) sent 03/03/07 8)
How do I go on to the template section to get the court letter. I have given Woolwich the time required and an extra few days to be nice but the gloves are off now. I just need to file at court but don't know how to go about this. I am having the same problem with Halifax so I will do both whilst I am at it. Have still had charges since filing my request. Are these banks ever going to learn??????
Any links would be most appreciative as would any advice
I have given Woolwich and Halifax the time required and no the next step is to start court proceeding. I have to say this feels me with complete dread and after reading lots of threads on here am lost. I received a link to start the claim through MCOL. But having read this see that it is advised to submit a N1. Is this correct??? I want to proceed with MCOL how do I submit it the link I had gave me a template but not what to do with it. If I go with an N1 form where do I get it. I am very sorry for my ignorance but have never done anything like this.
My claim with Woolwich is £2411.50 with no interest. My claim with Halifax is £4,403 again with no interest.
I would really appreciate some support and help with this next bit. Does it cost much as well????

Re: N1 form or MCOL?????? Please help
Hi Wifey,
Its not ignorance, its what we all feel when we set out.
The main difference between MCOL and N1 is the space to set out
your particulars of claim, the N1 gives more space and you will be restricted using MCOL (have a look in the FAQ's for more info on this).
Its not a problem really as the template section will have a template for you to use if you go down the MCOL route.
Alternatively, go to your local county court and pick up an N1 claim pack.(this is availiable to download online, but I don't have the link - though I suspect it will be in the FAQ's)
Check costs here - which your Bank will have to pay at the end of your claim: HMCS Court Fees
Lots of useful info there too.
If you claim any benefits look into the EX160a leaflet.
