my husband and i have separated , we have a joint account which i opened in 1993 , i havnt taken my name off the account as i wanted to reclaim my bank charges ( i do not use the account at all and have a separate one with a differant bank )
i am now panicking as i am at the court stage , i am waiting for them to put in a defence and i DONT want them to just pay the money into the bank account , my ex said at first he would give me the money but now i am doubting he will, should i
a. take my name off the account and continue as before and wait for them to contact me ?
b. call them to advise if they settle i will need a chq
c. nothing and pray i get to the account before ex when they pay up ??
i will go mad if after all this he gets all the charges back..please help i really need this money back as ex gives us virtually nil,

request it is paid by cheque as you have other debts to pay & as its YOUR money they unlawfully took from you, you should be able to decide to whom it goes too

at what point should i say this as i have read of many just checking there accounts to find the money sitting there, should i write to them now ?

Hi disney, I would write immediately (registered post for just an extra 70 pence) PLUS I would email them (copy and paste letter you're sending). That way, they have no defence to say they credited the funds to account because there was "regrettably a cross over in post with Ms xx request".
More and more, I hear of the Woolwich claiming that letters/action have occured then mysteriously leters arrive with claimants the next day after they complain - many letters would *appear* to be backdated to tally up with what customers are being told on the phones. I've recently had personal experience of this so have begun emailing as a back up of all hardcopy correspondence I send.
Emails are admissable in court as documentary evidence of actions or lack of
