Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I seem to be at a stage where most people are with A&L. I have a court date set for 24th May - 2 weeks away.
I would like to know what is the best way to go with this:
1) I have prepared a bundle of everything I have had to with this claim and have it ready to send to court & A&L's solicitors.
2) would it be wise to write a letter to A&L and their solicitor offering to settle for a little less than the claim amount?
3) or maybe a letter giving them a little nudge
I really dont want to have to go to court as my hubby and I are both tied to work that day and it would cause problems.
Please can someone help me - i have been told to sit tight but it is getting a bit ridiculous and I dont want this getting out of hand. I havent heard of anyone recently settling since A&L started sending out these defences.
Whatever you do Sarah, don't write telling them you'll settle for less!!!!!!!!!!!!
Look, you've done all the hard stuff, now all that's left to do is to wait. And apart from anything else, if you cave now you lose all the money you've forked out for letters, court fees, etc.
Remember 'fear' is what they (the banks) want. If they can make even a small percentage of claimants afraid enough to back down, then they are quids in, can't you see that?
If I were you I wouldn't send them a 'nudging' letter either, just let things play out now.
You will not have to go to court. No bank wants to go to court. They cannot stand before a judge and justify the rate at which they have set their charges.
You haven't heard of any settlements recently simply because they're playing for time, the longer they can draw things out the more nervous people get, as you'll testify. And nervous people are the most vulnerable in this game - it's a case of who blinks first!
They say 'patience is a virtue'; well be 'virtuous', Sarah! You WILL get there.
Isn't it recommended by the Mods that a nudging letter be sent out to try to encourage them to settle before court? Interested in this one, as I'm waiting to hear of a court date

It may well be recommended, but I've not seen that it does much good - simply my own opinion that it's a waste of time and effort and was offered as such. Each claimant must take responsibility for their own claim and do as they see best. 8)

Thanks for that In my case I'll definitely be sending one, but I understand it's an individual thing.
