Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Posted of S.A.R 30 days ago yesterday, hadn't heard anything back so emailed them. Got a call back within 30 minutes from some woman who was very nice although did sound a bit simple. Anyway said some of my statements had been posted out at 1:50 so should be with me shortly.
Recieved them today with a letter stating heres your statements from June 2004 to present, we do not believe that previous statements held on microfilm fall within the scope of the Data Protection Act blah blah blah however as a GOGW the statements prior to June 2004 will follow in approx 6 weeks time. The Information commissioner is aware of the reply we send out and the length of time etc, as we send out the statements held on microfilm in a first come first served basis.
They must be very very busy lol
Had always thought i'd done well with my repayments for BC so was pleasently suprised when i added up the charges over £800 with the payment Protection Plan which im sure i never requested, but have a pending CCA request to confirm that, either BC or Capital on had a tick on the CCA which i had no choice in taking as it was already on.
Still got 2 yrs of statements to come so not sure what to do now, don't want to wait another possible 6 weeks to start the proceedure but also don't want to make 2 claims, so do i start and send a prelim letter for what i have and then just add the rest when i file the court papers?
I used the top one when i sent out my prelim for crapital one but have put 1 charge in for exact same date of june 25 2004 with claim date of today and interest rate of 24.9% the figures for interest are hugely different
the first one gives £14.24 Interest and the second one gives £20.76 Interest.
I started my claim with only the last part of the staetements, just got the rest in time for mcol, you could also send the letter about non compliance with SAR request, I think they do what they want anyway.
Hey Skunky?
What address did you email to? I am desperate to receieve the statements from them.... their 40 days is well and truly up and I have only received from now to JUne 04?
Thank you x
I won against MBNA, Nat West , Barclays, Barclaycard and PPI payments from Barclaycard
Abbey National still to go.... what will I do with my spare time?
and I am using the first spreadsheet, contractural throughout claim. I have put in a claim reserving the right to amend it when the finaly statements come through...

And thanks for the info on what speadsheet you used, thats the same one i used for Capital One so will probably stick with that even though it works out less.
Rest of my statements arrived today, haven't been through them yet but im glad hadn't sent off any prelim letter so can do it all in one go now. Didn't expect to get them for 6 weeks so quite suprised when they landed on the doormat
["And thanks for the info on what spreadsheet you used, that's the same one i used for Capital One so will probably stick with that even though it works out less."]
I am fairly new to all this myself and had problems with the interest calculations spreadsheets, I had excellent help from newey499 on the site who had a brilliant spreadsheet for calculating the various interest charges.
Ok Added everything up properly now in the speadsheet will be reclaiming £616.00 in charges with £271.73 of contractual interest to be added @24.90% = 271.73 and also 341.66 for the PPP with ci of 176.30. So grand total to reclaim a massive (well for me its massive ) £1405.69 which will pay it off and leave me about £300 quid as a bonus, feeling lazy today so will probably write the prelim letter in the morning
Hi skunk, you posted on my thread a couple of weeks ago. Been looking at CCI and just had a couple of questions. 1, If you're going for contractual why did you choose not to use componded contractual and 2, How did you come up with 24.9% as your interest rate? Good luck with it all
It says on my Barclaycard statements that my interest rate is 24.9% so thats what i used. I went with the spreadsheet that adds the daily rate of interest aswell as i'd seen a few winners who had been taliking about the daily amount of interest they were getting aswell. I haven't actually sent the prelim off yet had been waiting for a CCA agreement for this and forgot all about it.
