Hi Claire, welcome to the site. Yes you can claim the penalty charges back under the CCCS agreement although you will find that they will pay the monies back into your account but its still worth doing to reduce the amount you owe. My OH has been paying through an agreement to Barclaycard and although it is only a small amount, he refused the partial settlement and has raised a case to claim the remaining amount, preliminary hearing at the end of June. Go for it!
Hello i'm new to this site and I couldn't find this information anywhere?
I just wondered if you have an agreement set up with CCCS can you still claim the moeny from the banks you have an agreement with?
YUP! you certainly can - go for it ... I'm in the same situation & am claiming back from almost everyone I owe to .... I would advise only doing them a few at a time tho as it's more time consuming than you think. As another poster said tho - if you owe them money then they will probably (most probably!) use any repayment to reduce your balance with them - You can go online to CCCS website & reduce the balance if/when this happens. (Although tbh this doesn't bother me as my main priority is to reduce my debts)
Remember tho that any costs you pay out that are re-claimable (ie court fees) then you are actually entitled for the refund of these to be sent to you & NOT paid off your balance.
I actually told my CCCS advisor I was going to be claiming back charges when I started on my plan & he wished me luck! Said he would be interested to hear how I got on!
