    Default Barclays AQ defence?!

    hi,

    i have got my allocation questionnaireicon for Barclaysicon,

    bit worried that ive not done something quite right in the run up to this, mainly because of the first point of their defence,

    1. the Particulars of Claim do not provide details or particulars of the precise charges alleged to have been unlawful, or the date thereof, to the extent it is alleged that the Claimant incurred bank charges on his account for unauthorised borrowings (whether unpaid fees for returned cheques, "paid referral fees" or any other such fees), the defendant puts the claimant to strict proof of each charge and the date therof.

    is this normal?

    They are 'claiming' that you have not sent them a copy of your SOC to prove the amount you are claiming.

    Simply send them. and the court your updated copy.

    Send via recorded delivery so you can prove they received it.

    ok, thats what i thought!!

    i do already have proof of delivery of my lbaicon which had my SOC attached!
    i can request the signatureicon on the royal mail site, will cost me tho!! :0/

    but i guess i`ll have to play it their way and send it again, should i put it in with my aqicon thats here waiting to go or should i send it separatly?

    just send them together, also point out that they've already had at least 1 copy of it before,

    Surely braclays are lying in there defence when saying that they have not had the SOC's before. Shouln't this be enough to get there defence struck out if you have proof of all the other times you have sent it.

    23/02/07 Request for payment sent (hand delivered to my local branch)
    08/03/07 Standard Letter from Barlclays saying they are looking in to my complaint received
    13/03/07 Letter before action sent (hand delivered to my local branch)
    27/03/07 Partial offer of £1255 received
    29/03/07 MCOL submitted

    no point in trying to get their defence struck out, they'll just apply for an amended defence, just score the point by mentioning it

    obviously my SOC has changed slightly, with more interesticon added since i applied to go to court, will this matter?

    or do i just print out my excel spead sheet as it would be now and send that?
