Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have an account with the Bank of Scotland and I have encountered a few charges on the account over the past five years totalling around £300.
I have started action against BOS and here is my progress so far...
On May 2 I sent a DPA request asking for all details on all charges applied to my account within the last 5 years (I live in Scotland). Today (May 27) I received a big envelope from Bank of Scotland full of statements (and a nice big "Friend for Life" phrase on each one!). Shock horror - there is some information missing. The statements date back to August 2000 (before the period of my request) and only go up to May 2004. I am hoping that the one envelope wasn't big enough to hold all of my bank charges in so I shall eagerly watch the letterbox on Monday and Tuesday to see if the rest of my statements come in.
Now what I need to do is tally up all the charges on the data I have and see what the damage is...
Citi Cards - £75 of charges being pursued
19 May - 1st letter sent
27 May - Letter received detailing T&C and that their charges are fair and legal
30 May - Final letter sent appealing decision and advising of imminent court action
RBS - 2 accounts, approx. £1500 of charges being pursued
02 May - DPA request issued
HBOS - £296 of charges being pursued
02 May - DPA request issues
27 May - Statements received for period August 2000 to May 2004. Still awaiting full data request for all information available to 1 May 2006
30 May - The remaining statements are received.
31 May - First letter sent detailing all charges since 2000 and requesting that they be refunded.
I also only got the statements up to May 2004. However, they kindly enclosed a list of charges to my account from May 2004 onwards. Very nice of them as it saved me the hassle of trawling through statements!
I have just received the rest of my statements as per my DPA request to HBOS. I have calculated that all of the chargs applied to my account since 2000 total £292 which is around what I thought it would be.
I have just finished the letter that I am going to send to HBOS tomorrow which declares all of my charges to them, presents the historical legal cases and demands that the charges be returned. It will be printed and sent recorded delivery tomorrow.
I expect that I will receive the standard response from them but either way I will keep everyone posted of what they say next...
