    Default Hedgerow vs Woolwich

    Hi to all who are pursuing a claim with The Woolwich.

    DPA Request received on the 9th October 06.

    Nothing happened for months after this as I unfortunately had misplaced the Breakdownicon of charges they had sent me. (FOOL!)

    Eventually I found the paperwork with the list of charges on.

    Preliminary letter sent on the 16th April 2007.

    Received their standard response, we're looking into it etc... and will reply no later than xx/xx/xx date.

    letter before actionicon sent on the 1st May 2007

    Now just waiting for them to stall and delay things even more with there usual gibberish in their letters.

    Not that that will pose a problem though. Im sticking to my timescales, not theirs.

    Filing a small claimicon against them on the 17th May 07

    I'll keep you posted on what happens as things progress

    Hello again all, just a quick update,

    Received a letter from woolwich dated 16th May saying they are offering £200.50 as a goodwill gestureicon. Total charges are £225.00 plus £87.58 interesticon.

    I phoned them and spoke to one of their staff to see if they would reconsider their offer and pay the full amount rather than going through the courts. Needless to say they declined - they even tried to tell me that their offer included all the charges that had been applied, even after they sent me a Breakdownicon of charges which I went through 3-4 times!!!

    I supose this is how the staff are trained to deal with negotiations.

    Anyway, I wrote back to them declining their offer and have given them a further 7 days to reconsider.

    Just a quick update on the Woolwich claim.

    Claim issued on the 5th June 07 - deemed to be served on the 7th June 07. Defendant has until the 21st June to reply.

    Defendant acknowledged on the 19th June 07 and then submitted their defence on the 6th July. aqicon returned on the 19th July 07, now just waiting for reply from court to send off court bundle etc.

    Hi all

    I'm in the process of preparing my court bundle for a claim against Woolwich and do not have the terms of contract for the original account when it was opened.

    Can I use the Terms of contract from Barclaysicon which is in line with the dates when I opened the account to use for the Court bundle?

    Any advice will be helpful

    Hi Hedge

    Absolutely however if you have a while before you have to submit your bundle, I would suggest you do the following;

    Write registered to the Woolwich CustomerCare Services at Jackson House and request a copy of the T&Cs which were in force during xxxx.

    Put in something like

    "Where you are unable to supply such, please provide the reason why you are unable to access the Terms & Conditions under which I entered into a contract with your company. Furthermore where this is the case, and in lieu of the correct document, I require at least a copy of the Woolwich T&Cs which most appropriately reflect the T&Cs that were in force duing that period."

    I'll wager a tenner they won't send the original ones and if you're lucky, will simply furnish you with current Barclaysicon t/a The Woolwich T&Cs.

    The point of the exercise is for you to be able to demonstrate to the court that you made reasonable effort to present the T&Cs as documentary eviodence and that not even the bank claim to have access to them for the purposes of establishing the T&Cs relevant to your claim.

    You can therefore include your request & their response and the T&Cs they send back in your bundle.
