I have had a Barclaycard since Jan 2002, and did not realise until last year, 6 or 8 months ago that I was paying a PPI. I cancelled it, and thought no more of it.
However I have now started to claim charges back from B/card and requested a CCA from them which arrived this morning. The copy though is of poor quality and not clear at all.
However it appears that I did not ask for the insurance, it does not appear that I ticked the box,
If when I receive a better copy, and I am right, that I did not ask for the PPI, where do I stand in claiming back the premiums I have already paid?
Is it possible? If so, please point me in the right direction. Thank you

If you have not done so already, sent a Subject access request and get all the information of the ppi payments you have made to them.
Send a prel letter reuesting the refund, plus interest.
There initial responce will be denial etc.

I'm in the middle of a claim against Monument (still Barclays) theyve been charging PPI since 1999..... got my agreement and no tick or even no box !!!

I beleive that I can only make one claim against a company at any one time.
Question is, I am claiming charges back from Barclaycard at the moment, not at court stage yet....... Should I amend the claim to include PPI? or do it seperatly?

Personally I would start a seperate complaint regarding the PPI, This I feel would make your claim for charges go quicker without further complications.
Charges claims are pretty straight forward whereas PPI claims can be a longer process.

I have recently made a Data request for all my statements for the above account, and I have also received a copy of my CCA.
I have calculated how much I have spent in PPI since I opened my account, and frankly I was shocked. I did not apply for the insurance at all. The copy of my CCA does not show a tick in the box. To be sure I queried the paperwork and had two more copies sent to me. It proves that I did not apply.
What I require
I calculate that you have taken £544.82 from my account, plus the interest that you have charged me on this amount which is £370.73, Total amount payable please is £915.55 I enclose a schedule of the Payments and interest which I am claiming with this letter
My targets to resolve this matter
I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you will prefer to do this than merely respond with standard letters and leaflets.
I will give you 14 days to reply to me accepting, unconditionally, my request in principle and letting me know a date by which I will receive payment.
If you do not respond, or you do not respond positively, within this time period, I shall send you a letter before action giving you a further 14 days in which to reflect. I believe that these targets are more than sufficient for a large company such as yours with dedicated staff and departments.
If I do not receive a favourable response from you I will pursue this claim through the Financial Ombudsman.

I personally would not even look at the fos.....they could do with getting a spine inserted.
go straight for the court, but at the same time make a complaint to the OFT and trading standards, (who also need to get spines). The OFT is at the moment investigating the misselling of PPI and have recently fined GE and cap one a total of about £200,000.

you have obviously used the bank template refund letter which is ok I s'pose.
so why not use the lba one as well,k edited of course.
or something like
" on the ddmmyyy I sent you a request determining my claim for the refund of wrongly taken amounts from my account relating to payment protection insurance.
this insurance was not agreed to at the time and was taken without authorisation from me.
i will give you a further 14 days to reflect and to enter into serious dialogue with the intention of refunding the aforesaid amounts.
At the end of this last period and without further warning I will enter a claim into court for the full refund plus interest which will amount to £ nnnnn.

or something along those lines. pad it out or put other stuff in.......but leave them in NO doubt that you intend to further your claim by court if necessary.

Can I have some help please with my next step? lba is well and truly up now, with no response, just an acknowledgement that they are looking into my complaint etc.. I cannot afford the pennies for a couple of weeks to go to court as we are going on holiday next weekend and need all the spare cash for that.
If I were to try the OFT/Trading Standards, can anyone help me word a letter to them? Maybe I should try writing this same letter to all three, (the fos as well)

The OFT and TS also need some help with getting a spine, you probably wouldnt get much joy there either
Are you on any sort of tax credit / or assistance, if so you can file the claim for free. you need to download form ex160 (I think)
I'm sure the OFT and TS have downloadable forms for complaint, just give the basic factual details of the complaint. they will ask you if they need any more info.

Same has happened to me with Dell computers.We told them firmly NO PPI over telephone.all business was conducted over phone.I found agreement today,no PPI box to tick,yey they have been adding the PPI amount ,of £3.59 per month,since September 2006.
My husbands signature is on agreement form,but no PPI box,just a paragraph on form telling us we have it and the amount we must pay each month on top of loan.
