Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I sent my lba off to Lloyds just over twoo weeks ago. As yet no response.
I was hoping to be able to call the bank and see if I could hurry them up a bit before a file the mcol... The only number I have is the 0845 customer services number. Can anyone help?????
All I have had so far is the usual letter right at the start of all this stating that they will "look into it" hummmmmm.
Having read some of the threads I have seen that some people are claimg charges plus contactual interest. Up until now I have only asked for the charges back.
When I file the mcol can I include interest or is it too late now?????
Hi
If I was you I wouldn't bother trying to ring Lloyds, you won't get anywhere.
You can add on the statutory 8% interest when you file the Court claim, but I think (though not 100%) that if you are wanting to claim CI, you should have put it in your Prelim and lba.
I am getting my mcol ready. Can anybody give advice about the 8% I can now claim (I think) I did not add the 8% onto the shedule of charges,do I add it onto the mcol form?? If so where and how?
Have checked with mcol and they say defence was entered on June 29th (not 19th as it sayd on website). I still have heard nothing from either mcol or Lloyds in writing. Mcol say I should have a copy of the defence in a few days but they said that last week too, also have had no word about a transfer to local court.
As it has been nearly a month now sice defence was files I am unsure of what to do....... Getting VERY fed up of hearing nothing
Does seem to be draggging on a bit I would agree - but this is probably just a reflection of how clogged up the courts (and in particular MCOL) are getting with these cases - personally I would keep pestering MCOL until you get what you need - certainly a call every couple of days to start with and maybe more often than that if still no joy.
Quick update....... As i said before Lloyds entered a defence on June 29th. I have now had a copy of defence and a letter from Lloyds solictors saying that they intend to ask the courts to pospone all claims until the test case is over. I called mcol helpline who told me that it is likely that cases filed during August will be "put on hold" but as the defence was filied back in June for my case it should not effect me. But as yet I have still not had my case transfered to my local court........
I'm not sure on what I should do now I have emailed and called both mcol and Lloyds but don't seem to be getting any further forward..... Even if I just got conformation that my case was on hold would be something, at least I would know where I stand.
Any advice anyone !!!!!!
