Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have written first letter to Natwest requesting £80 they charged my credit card in late penalty fee for the last 6 years on the 11th April. I know it is not a lot of money in comparison with my claim against HSBC of nearly £5K, but it is my money and I think I should get it back even if it is £1!!!
Anyway, I have received a letter back offering me £33.92 out of the £80. I wrote back rejecting the offer, but they again wrote back saying that they would not give me a penny more that the £33.92.
My question is: Is it worth going to court for £80? I know that by the end of the day, once I add the 8% interest and so on it will come over £100 + court fees.
You will win, but its just the waiting and playing the game in the meantime. Well done for being brave enough to do it. Im sure they would have been banking on the fact for that small amount that you wouldnt be able to be bothered to go through with it. So well done for proving them wrong. You will get it all back. Every last penny, so in the end its simple. YOu win, it just takes a bit longer thats all. Well done. Fendy xx

Hello, well Natwest acknowledged my claim on 10th May. I never heard from them!!! I thought it would be quite straight forward as it is a very small claim compared to the others around us. I will be very upset if they let to go to court stages as I had a big claim with HSBC which they paid no problem before it reached the court. I will actually be quite surprised if they let it to go that far as they haven't so far (especially with such a small amount!!!!)

What you must realise is that there seems to no set pattern to way that these claims are settled.
As we have already stated it would make sense for your £80 claim to be settled prior to court but then again, when have the banks ever employed sense in their decision making.
