Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
This is my first post in this part of the forum. I have begun my claim against my old Barclays account and Barclaycard and sent off SAR requests.
However, I am a little worried because I haven't paid my Barclaycard since around November 2005, and there is still an outstanding balance on it. I have moved twice since then, but have notified Barclaycard of my new address each time, but they still haven't contacted me. The last time I saw a statement posted to me (around the time I last made a payment) the balance was around £450, however I have called them recently to ask for a balance and been told it is £850ish (mostly due to charges I assume!!) The account is still with their internal DCA, Mercers I believe, although thwy have always been closed when I have been able to call.
Now, I am not naive enough to think that I have got away without paying this balance, and as soon as I have got through some financial difficulties this month and next I intend to contact them and offer to come to some arrangement over the payment.
However, do you think it's a silly idea to proceed with my claim for charges given this circumstance? Am I just inviting further action against me? Has anyone else been in this situation before?
