    Default ArohemQ v. Barclaycard

    Claiming default charges of £140.00
    Plus s69 Statutory interesticon as at 28/04/07 of £48.72.

    05/03/07 1st Letter sent.
    13/03/07 Barclaysicon acknowledged receipt
    15/03/07 Barclays Goodwill gesture, offer of £56
    22/03/07 Rejected offer, sent 2nd Letter.
    27/03/07 Barclays sticking to guns, offer remains at £56.

    Barclays paid the £56 into my Barclaycard account on the 15th of March but I did not accept this as settlement in my 2nd letter sent to them.

    Been on holiday and a bit busy at work but am now back. I intend to pursue further with county courticon and came over here looking for advice using MCOL but some have suggested going via N1 submission.
    1. Can someone please advise me the merits of one or the other? [MCOL v. N1]
    2. I've been reading Contractual Interest debate(s) keenly. Can I change my demand from statutory to contractual at this stage?
    I am also seeking default charges from :
    • MBNAicon: £380 + s69 £132.11
    • Barclays Bank: £855 + s69 £334.02
    • American Ex: £270 + s69 £94.68
    • Halifaxicon: £165 + s69 £60.40

    I would stick to statutory interest as you need to ask for CI from the start also the merits of claiming CI and not proven.

    MCOL is easier and the fee can be paid online using debit/credit card, all documents are generated by the court. POC is limited on MCOL and this may lead to problems regarding

    N1 enables you to include a full POC.
