Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I received my bank statements off a&l on thursday that was 38 days since i requested them. I spent all Thursday night working out the bank charges i got that figure to just over 1,500.00 and posted that off recorded delivery yesterday (27th apr). Guess the next step is the sod off letter. I am worried they will close my account down but i guess i will cross those bridges as i come to them. Any advice in laymans terms will be greatly appreciated.
dont worry about them closing the account - in my offer letter (rejected) they said they will not be closing my account whether I accept their offer or decide to proceed with a court claim. They know they will be fined by the financial Ombudsman is they take retaliatory action!
ok well i have received my first sod off letter today. I have printed off the 2nd request letter thingy, does anyone know whether i have to wait till the 14 days i gave them to reply is up before sending it. thank you
sorry changed my mind not doing it through mcol now going to file an n1 instead...........
does anyone now whether you can send n1 with a postal order for the 120.00 direct to the court or whether you have to appear in person and do i attach a list of the charges to the n1 when i first file claim. Hmmm oh yeah does anyone know in laymans terms how to get the n1 from the library to your computer it won't let me copy and paste and i am not really that computer literate sorry
I think i posted my last request in the really wrong section. I am not very good at this. sorry.
please could someone tell me whether you can post the N1 off to the county court with a postal order for payment and whether i attach a spreadsheet of my charges to this at this time or do i have to appear in person struggling to get time off work and i can't work out how to attach anything to the mcol one
Also really thick question how do you get the N1 from the library onto the computer or do you just type it and then print it straight off it won't let me copy and paste.
Re: aaarrrggghh please advise about starting court
i used MCOL - if you go to dark blue toolbar and do search on Michael browne you will see a list of threads - he has a good one - I think it is get MCOL right.
There is a template for all the coorect words to complete - then you send your copy of schedule with a separate column for the 8% . There is a ink to the spreadsheet as well.
If you use MCOL you will have to pay the fee by card i think (unless you are exempt)
Keep reading FAQ/ Step by step instructions and libary templates.
There is also a section about the advantages of using N1
When the Liberals and Conservatives were in opposition they both agreed that banks should pay back high bank charges to customers. Nothing seems to of happened since they came into power as a coalition. PPI insurance has been sorted now they should turn their attention to bank charges and help customers get exorbitant charges refunded.

does it matter that i am going to have to wait another week or so before sending my n1 etc as i am skint again (bloomin Kids) it will mean they have had a month not 14 days to respond
It's your timetable so not at all. If you are on certain benefits you may be able to apply for exemption from paying court fees. Check with the court if you think this may be possible.

i have checked through a few things on other threads because my bootle address for a&l doesn't register with the address look up on mcol so do i use the narborough one also when i put on my account number for a&l do i use the one including the last digit of the sort code or the one i would use to set up direct debits without the last digit of the sort code also it says i need to include the alternative argument s.15 supply of goods and services act 1982 and i can't work out which bit this is in the mcol particulars of claim information and wording...... gosh this is so stressful but i know it will be worth it...... Thanks for all help so far its good to know you are not alone

If/when you get to court bundle stage and want some advice, send me a private message (tab above) and I'll send you some stuff to guide you (I've just done mine so know what it involves). Hopefully I'll be able to help you out quite a bit and it won't be so daunting.
It helps everyone if the advice can be kept on the open forum. There's a basic court bundle in the bank templates library, which just needs your own statements and letters adding, although you may have a few other bits and bobs you might like to add.http://www.consumeractiongroup.co.uk...rt-bundle.html
