    Default Can I estimate Barclaycards debt to me?

    Barclaycard have not sent me the statements requested so can I just estimate the charges??

    Whats the chances of that working??
    Are there any guidelines?

    Will you be able to defend your figures, why not harass them till you get your statements, my o/h sent his S.A.R - (Subject access requesticon) on 26/02/07, still waiting, he phoned them today to let them know he's quite willing to sue them for non compliance, he was assured he will have them asap...lets wait and see.

    I kind of just went for it.....
    Just sent them a demand for £4000, If nothing else it might hurry them along to sending the statements....

    You can, they refused to send me all my statements before the microfishe ruling so i took my greatest period of charges over 12 months, times it by six years to reach my figure. It has to be based on fact and state you are willing to amend the figure as soon as the bank comply with the DPA and send you your statements as required by law. I have had a judgement by default and am now working out the payment etc without even having all of my statements. Iim still consdering a court case for non compliance with the DPA though.

    Trouble is they have basically ignored my request. They appear to have forwarded it strait to cabot for some reason even though the debt was sold to Thames Credit??

    I just kind of guessed at a figure and thought it may force them to send the documents that they are required by law so time will tell...

    And it starts....
    Barclaycard today offered settlement of £200 rather than the £4000 I have claimed!!

    Just sent them a nice letter refusing the settlement and requesting full payment within the next 14 days.....
