Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I wonder if anyone can help me out. I have received a Congestion Charge penalty notice from Drakes for a total of 168.16. I'm not contesting this but at the moment can't aford to pay the whole amount right now. I called Drakes up and asked if I could pay 50% today and the reminder within 28 days.
I was told that this was not possible as they have an agreement with Transport for London that full payment has to be taken.
Can they do this ?
I am having a similar problem with Drakes over rent on my shop premesis I have contacted the landlords who I am waiting to get back to me but I have only 5 days or I will be closed down!
The Transport for London Contract with Drakes Group Ltd states on Page 15 the following:
"have the option to enter into any lawful payment arrangements between the Debtor and itself to secure payment of the debt"
Write to Drakes immediately quoting the above and requesting payment on the terms that you have offered. In your letter, I would advise that you tell them that if this is rejected, that you will take the matter up with Transport for London......
