RBOS are currently sending me all the nasty letters demanding that I clear my unauthorised overdraft which has reached approximately £128. They say that the case will be going to the court/sheriff officers very soon. The problem that I have is that the £128 overdraft was arrived at purely as a result of charges. I am currently trying to get my charges of approx £4000 back from HBOS so why would I pay £128 to RBOS for an overdraft which is only there because of no funds being in the account to pay a Standing Order for a few months. Should I let them take me to court and then ask them to justify the charges?

Don't let the bank take you to court.

YOU take the BANK to court for repayment of unlawful penalty charges, levied on your account.

Phone the customer services department, explain what has happened and ask for them to remove the charges. (This is a two fold, one it might be the quickest way to settle, and secondly if it does, and i doubt it, goes to court you can say you tried to sort it out without the court actions)

 

If that doesn't work, then write to them and send a copy as well to the customer services in edinburgh, also ask for a break down of the charges (which they will not give you). See how that goes. If that doesn't work and they are still threatening court action, point out that the charges are unlawful and that if they take you to court they WILL have to give a breakdown of the charges. Also get all your statemnets together, create a spreadsheet and relative word documents. Just in case. If you are at the letter sending stage you can have these handy for if they refuse to be fair.

 

The law is on your side.
