Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I had a computer from Time in 1998 on interest free for a year as well as a credit card from Alliance and Leicester, at the end of 1999 I got put in prison for 18 months in this time I had both of the companys on to me and they both froze the accounts.
When I was released in 2001 both of the companys passed on the debts to debt agencys - Cabot and Moorcroft.
Both of them chased me religously and I ended up starting to pay them which I now know was wrong ,the original price of the computer was £1250 ? i think but with all the payments I have made over the years it is still £1684 my debt with Moorcroft was £3000 I believe but is now down to £750.
I have been paying regulary for the last 3 years as have been in regular employment but havent really made a dent, and as of this week I have been looking into getting a morgage I have got a equifax report as was turned down and have found I have ccj from 2004 when I wasn't paying so regular.
What action do you believe I should take to both companys as it seems I have payed out alot of money with out actually getting anywhere except from being ripped off by said companys.
Thanks for having a look over my problems and if you can help in any way it would be much appreciated.
I belive the first step would be to send a CCA request letter to obtain a copy of the original agreement.
You also want to send a DPA request to each and ask for a full statement of the account.
You should work out your position and what has been happening with your accounts in relation to unfair charges and interest before you can think about sorting them out.
Also ask the court for details of the CCJ. You might be able to work on that a bit more too.
I got round to sending off the CCA last month then waited the allotted 14 working days, Moorcroft who are handling the debt got quite snotty that I was asking for the CCA said it wasn't up to them to retrieve it but would get on to Alliance and Leicester and even said they may not have record of it as it was 1998 when I applied for the credit card.
That was 10 days ago now I've got in and have a warrant from the bailiff from Alliance and Leicester saying I have defaulted on my my judgement and now have to pay 152.25 by the end of the month.
They still haven't sent my CCA, what would anyone suggest my next move to be. When I spoke to them say 10 days ago the said that they hadn't received my request for my CCA.
Thanks looking forward to some replies to help me.
I am wondering if you should actually be in one of the other sections
if you put Cabot in as a search above I think you will find there is LOTS about them in "general debt" section I think
