I sent off my DPA request letter for my statements going back until may 2000.i sent off a cheque for £10.00 to cover the costs.I received a reply from them today
saying they would gladly send me the statements in i sent them a cheque for £10.00 to cover costs.As i had already sent them the cheque and the cheque had being cashed i rang the number on the letter thy had sent me but after 2 hours of getting the engaged tone,i rang them on their normal customer service number.after talking to one of their staff they told me they had no record of any cheques from me but would refund the money to my account.also so they were going to charge me £3.00 for every statement before may 2004.on the letter they sent me it said "please note statements that are prior to may 2004 are not held on a computer system or a structured relevant filing system and therefore,they do not fall under the data protection act 1998.They can be obtained from our customer services dept at a cost of £3.00 per statement." This would mean i would have to pay £144.00 to go back the full 6 years.IS THIS LEGAL AND CAN IT BE ENFORCED.

Just a suggestion, but I am taking a photocopy of each cheque I send so that if they cash it and then claim they know nothing about it I have evidence to back it up.

Doesn't prove that particular cheque was made out to them. I've had problems with this before. You could write in any name on the counterfoil. The cheque number only proves the cheque has been cashed.
You can go back to your bank and ask them to trace who cashed the cheque, but they will charge you for it and it can take a while. It's less hassle to take a copy upfront......
