    Default Nads V Egg

    I sent Eggicon a prelim out on the 18th December 06 (along with other institiutions) but had the "your not having it back" response from them a few days later. In the meantime i entered into a court case with Barclaysicon which i finally won but never got onto the Egg charges. Now im finding time to sort out my backlogs. I know im to send the letter before actionicon now but will it matter that more than 3 months has elapsed since my initial claim? Other letters have always said "we will consider this matter closed if we do not hear from you within x time" but the egg letter doesnt state this so will it be ok to carry on now?

    Capital One Credit Card - Sent S.A.R 22/09/06 - statements recived 30/10/06 - Settled Dec 06.
    Egg Credit Card - Sent S.A.R 22/09/06 - statements recieved 30/10/06- about to send prelim
    Barclaycard - S.A.R 22/09/06 - Microfishe letter - non com. 29/09/06. - wont comply letter - 16/10/06 16 days left- getting nowhere letter back! 16/11/06 Information Commissioners Office compaint - 18/12/06-Statments sent - prelim going out 24/5/07.
    Virgin/MBNA - S.A.R 22/09/06 - part pay accepted - settled.

    Nadia, anybody who took your money unlawfully is in no position to "consider the matter closed". It's your money, thank them for keeping it warm, but you want it back now. Claimants are on a winning streak (see V-E Day), in many recent wins a resolute letter written with conviction (tell Eggicon you KNOW the score stands today at 37-0) proved to be sufficient.

    It wouldn't matter if they did consider the matter closed. You are the pursuer not them. It will only be closed when you or the courts consider the matter closed.
