Anyone Here Claiming Contractual Interest With Barclaycard???
Hi everyone,
Just wanted to touch base about CCI & find out if anyone was/is/was going to, claim Compounded Contractual interest with their B'card??
I have, at last just done one claim for Capital One with CCI, which ended up being a nightmare task, however I managed to do it in the end!
Now I have done one, I am confident of doing another, though I am fully aware that B'card seem to be more ruthless than others, in fact they have a reputation of being positively horrific & that makes me a little nervous.
Soooooooooooooooooo, if anyones out there that has been successful, or is in the process & has either good or bad experiences I would really welcome your comments.
By the way my claim will be for £546, & then will have the interest on top, at either 8% standard rate or 24.9% CCI.

I will be adding CCI wit barclaycard as soon as they sent me the missing info( filed N1 for DPA non compliance).
My task is easier as i ve got 2 sister that deal with banks on daily basis, so i ve been already been informed of all upperhand tactics and te similar.

Phew, what a time I'm having with Barclaycard!! Account number not known but sent off ALL my personal details to B/card with SAR in March.
They wrote today back saying your details have prob been deleted ... from 2004? It's not that long ago! I've contacted my bank (Coop) and after a lot of searching they found my old a/c number from a payment made. So, written to B/card again today
Anyway, sounds like you'll be ahead of me this time with CCI for Barclaycard and I certainly intend to claim it after all this mularkey.

Most of them are already known the one that strike me is their denial of charges being fair and lawful but then when anyone files at court they buck up their ideas and pay straight away "without admitting liability".

Wish I'd known about contractural interest earlier, have filed hubby's allocation questioner and only claimed the 8%, as he will only have an outstanding balance of £123 once we reclaim penalties, we maybe could have wiped it out - by the way does anyone know if there is a huge backlog of cases, we sent aq in 16th March and have heard nothing yet.

I strted one THERE about claiming a higher rate of interest. I'm not very mathematical though, so a quick question. Is the higher rate of interest claimed using the "Simple Spreadsheet"? I wouldn't be able to work out the second rate!

Halifax Prelim letter sent 2/08 Fob off recv'd : 7/08, Settled 17/08, without LBA even being sent : £240 agreed, just £28 short of what we were claiming for!
BoS: All statments recieved, totalling £1,680 before intrest, 09/08 CCA Request sent to Hollis Briggs Solicitors, Prelim sent on 12/8. Hollis briggs never did reply to the S.A.R - (Subject Access Request). LBA has been sent, and action has begun in the small claims court! Return date 2/11, Prelim. hearing 9/11. Hollis Briggs have dropped the account, which is now back under BoS head office control! BoS ignored court claim, and din't reply at all. Spoke to rachel Hinchliffe, who said they did not recieve summons, now in her personal hands. 2/11 - Recieved noticed of debt collection on this account from Wescot, just more evidence of icompetency, and for court!

I sent off my n1 form with list of charges and included simple contractual. But the court has sent forms back saying if i want to claim contractual interest i have to supply a copy of the agreement. Not sure he they want the actual signed agreement or just a list of terms and conditions. But have no way of getting the original terms and conditions from when opened account as over 6 years ago. So its looking like i might have to in back to the 8% route.

I had no idea they could do that. It shows that these banks etc are getting wise to it all.
I wish there was some kind of standardisation with all this. It makes me really mad - in some case CCI has been paid no problem, & then poor you comes along & they start spouting that you need terms & conditions etc. Yeah right, just hanging around from god knows when! Grrrrrrrrrrrrrrr
You should hand it back to the court & say that either you need more time & send off a demand for the agreement from B'card, & if its not sent to you within 12 days then they will be in trouble with the court.
Or can you not call them?? I know it seems daft, but its always worth trying!!

Hasn't even got that far. The court has sent it back and the bank doesn't even know i'm bringing them to court. Makes me start to think something sinister is going on between the banks and the courts, especially now tsb have won a case. Maybe its just me and conspiracy theories. Might just send them again with statements, surely thats enough evidence.

bluedannyw on each of your barclaycard monthly statements it states clearly the interest rate which you should charge for compound contractual interest - it is the purchase annual rate as stated in the blue panel on the left hand side of the monthly statement.
Check through your statements to see if this has varied over the years.

Once you get it open it is straight forward enough.
If you want to know some of barclaycard's backhanded tactics, here are a few:
Every time they write to you they will reply from a different address in a different city, signed by a different person.
The person signing the letter will tell you that you can get in touch with them but they will not leave a phone number or if they do and you phone to get in touch with them, you will not be able to speak to them directly but to someone else in the office who has never seen your account.
They will disregard the bulk of your correspondence with them and regurgitate standard replies. Ie if you mention that there are default notices against your credit record due to fees and you want them removed they will ignore you.
If you say you agree that it is fair that they recover costs but that you do not agree that £12 reflects their loss they will reply: we believe it is fair that we recover costs....
IE: THERE IS NO MEANINGFUL DIALOGUE
(Sorry for shouting)
So don't be too lenient with barclaycard especially in wondering if you should give them more time to consider.
Of course if you do this, your claim will grow by the day.

PS Danny, I find it strange that the bank requests your agreement - the details of agreement are printed on every monthly statement you receive - it states the costs of fees and how they are incurred and also it states the annual interest you are being charged, this being the figure you use to claim back interest.

PS I have just noticed that also no the back of the statement Barclaycard want to charge £3 for every copy of statement requested... Of course we only paid £10 for the copies of our statements going back how many years? Isnt this another example of barclaycard ripping people off and also deceiving their customers, perhaps even deterring them from access to hard copies of their records?

just after reading aronski's post about where the interest rate number is, I found out I'm charged 37.9% interest! am i likely to get this amount back if it goes to court?

Just thought i'd clarify the point, its not the bank who has said i need to include the agreement. It is cambridge court who hat written this to me. They have not even continued with case as they have sent me a cheque back for the amount i have paid for the court action.
