Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
My son opened our van door and touched the door of the car in the next parking space, my van left a smidge of white paint on her door. I gave her my contact details and she is now saying that the dent (which I did not see at all despite looking closely) needs filling and the door respraying and she will send me the bill.
Firstly - I saw no dent when I examined her door just a bit of paint less than an inch long, I felt this would t-cut out
secondly - I had parked correctly in the bay but she had parked real close to the line on her drivers side making it difficult for my son to get out without touching her car.
What should I do??? I can't afford a big bill and don't really want to claim on my insurance as I really feel she is trying it on????
Tell her that you are not accepting any liability for the costs until you have seen and approved the cheapest of 3 fully itemised quotes for the repairs.
Take it from there.
Next time (!), make sure that you take pictures of whatever damage occurs straight away. If you don't have a camera phone, carry a disposable camera in the car for that purpose. (something everyone should do anyway)
Apologies to people who I was in the process of helping, I may be gone some time.
Also get her to send you (photo) , or go to see the damage that is now on the car before agreeing to repair.
I am happy to offer helpful advise in many consumer problems based on my retail experience. I do not represent any company, and any advise I do offer is my opinion and how I understand the law. I have no authority to create any terms for any company I do work for and will just nudge you in the right direction without breeching their trust.
Sending her this email (she has already left a message on my answerphone and emailed me - details were on the van). Is it OK do you think?
I am concerned that you feel that there is a dent in your car following your claim that my son touched your car with my van door. From my perspective when you showed me your car I could see no evidence of a dent. Could you please provide me with a photograph of this dent to clarify the situation.
Poppy, stay calm love, you have a witness, she doesn't, you handed over your details, let her take you to court and watch the judge throw it out, firstly as it was not you who hit her car with the door, and second, a pathetic dent, come on.
Better still, get your sons mates to pay her a visit just to really make it worth her while! Only kidding, send the cops round for harrassment, hehe
As you can tell, I'm not in a tolerant mood tonight. Sorry.
Yeah but it was his/her son and not him/herself...
Who cares if it breaks the law anyway... too much hassle, wasnt like there was a huge dent or damage to it... its surely no different then cleaning off bird sh*t or tree sap??
Still her responsability.
Who cares? We, at CAG, do, we pride ourselves here on keeping the moral and legal high ground. This kind of advice is unwanted on here, so if that's all you can come up with, please refrain from posting. If you persist on advocating breaking the law, we will moderate your posts.

Kidding or not... A judge would not necessarily throw it out, because at the end of it, she has admitted her son has caused some damage. The quantity and cost of damages are still to be quantified, but a judge would be far more likely to rule in favour of the claimant since there is no argument there was collision.
A "pathetic" dent? Well, that depends on the age and condition of the car, actually. If it is brand new out of the showroom, you betcha it will cost a lot to fix. If it is a B reg Ford Cortina, not so much... ;-)

No one gets my sense of humour then. Its been taken as if i was planning a serious crime (murder, terrorism etc.), i am not, was just joking.
Precisely, I myself have a new car and I don't like it being dented or scratched, but believe me, it happens, and the culprets just shrug it off like nothing has happened, so what do I do, take everyone I come accross to court for the slightest thing?
I do agree that we should play fair and by the book, however, in this case it appears that the woman is trying to take Poppy for a mug, and she shouldn't have to stand for it, I, like ManagingDirector was also trying to make light of things and I'm sure Poppy took it that way, no-one here honestly believe I meant any mailice?
If you saw the posts I have had to moderate and take action on over the last few days, you wouldn't even ask....
Let's not forget that in writing, one can not see the tone, therefore, things have to be taken at face value... There was nothing in either post to indicate that they were meant in jest. And we can not jeopardise the site for a joke that didn't look like one.

Okay, I most sincerely apologise to all in this forum if I have misslead or upset in any way, in future I will try to be more specific, and if I am joking I will use lots of

So, Poppy, did we help you at all? Sorry bout all that. Anyway, try, if you can, to reason with this woman without using anyone's insurance etc, offer her the lowest quote in cheque, so it can be traced and prooved you paid, and of course receiving a receipt of Full and final settlement.
Also when you go with the cheapest quote, tell her to tell the garage to bill you direct and you will pay them direct. That way she can't t-cut it out herself and pocket a load of your dosh. That it self should be enough to stop her in her tracks if she is trying it on and 'loading' the cost of repairs.

trouble is - if she's a spiteful so and so she may go and get 3 pricey quotes and have the work done, when a quick polish would have worked.
