    Red face What the *** is going on !!! - Any Mods advice !!!

    Hi Guys,

    I been quietly waiting for my paperwork for my case in my local court. I issued preceeding against RBSicon at the begining of March 2007, to date I recieve usual aqicon from Cobbetts, but since then very quiet on all fronts. I orginally went Fast track because my claim was over 5K. To date I have paid £350.00 and when I called the courts today to get an update, I was told a listing questionaire is being sent today to me with a pre hearing review date of 4th July.
    I am to fill in this questionaire and send further payment of £275.00 to cover trail costs. (What the ****!!!) I was also informed the the case would be scheldule for some time in Oct 2007 - 30 week window from when the original preceeding were allocated, the Judge has taken an interesticon to my case and would like both parties to provide information that will help decide time required in open court and documentation to be put forward (what the *** !!)

    Now has anyone else been down this route ? - is this right - what about spiralling costs - do I now need a solicitor cause open court ain't my thing, what the *** do I do !!!

    Reading the forums- I did not expect to go down this route on fast track, even on the larger claims that others have received.

    Any advice please

    Did you originally file the papers for a fasttrack claim or did you file the small claims and the judge raised the level to fast track?

    How much over £5k are you?

    I have now taken 3 banks to court as small claims for well over 5k each and they all stayed on small claims.

    1 of my claims (not bank charges) was nearly moved to multi track at an allocation hearing but I revised my POCicon to remove the more complex data protection issues and detailed damages claims. But this was an abnormal claim. It is now staying at the small claims level. I did also speak to the defendant ad we agreed small claims was best for both parties.
