Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I am in the process of paying off an account with Tradepro, i was paying this to a debt collection agency (Sherforce), but recently received a letter from sherforce informing me that the debt has been passed back to tradepro.
tradepro have gained a ccj against me for this debt at the start of last year,
i recently wrote to tradepro as the amount owed on my monthly statements is different to the amount remaining on the judgement, and have as yet received no reply
The original judgement amount includes roughly £500 of charges (£30 per late payment charge, or collection charge as they call it)
Should i SAR tradepro to reclaim these charges?, can anything be done about this ccj as the majority of it was for these charges?
My husband had an account with Tradepro as he is self-employed but slipped behind on a couple of payments when he had no work. He agreed to pay £40 a week to them (which is really hard to find). Since we made the agreement we only missed one of these payments but they have put interest on, and on and the company called CDC Debt Collections keep ringing up constantly. Sometimes my husband is on a roof or up a ladder when they ring which is highly dangerous. We are feeling terrorised by CDC and we only missed the one payment.
We were told that although interest would show on our bills from Tradepro we would actually get the interest taken off later on! But after ringing Tradepro this morning was told that we had been told wrong, they cannot put a hold on the card and interest will accumulate and they now want £45.00 a week and the debt has gone up from £800 to over £2000 now with all the interest.
We don't know whether to pay them what they are asking i.e. £45.00 a week or stop paying altogether and let them take us to court. Surely they cannot harrass us with these phonecalls and threats when we have been paying constantly £40.00 a week for 3 months now and only missed the one week!
i rang tradepro and queried this, they said my account is now in the hands of lcl law, which happens to have the same address and a very similar phone number to tradepro!!!
After speaking to them they confirmed that they would credit the interest and collection charges back to my account, halving the amount owed

im not in arrears or anyhing just need advice on how to handle the situation.
can anyone help thanks
Having similar isues with these idiots.
Ask them for the CCA and you'll get an application form which doesn't have any prescribed terms on it AT ALL.
They send a letter after your application saying "welcome, your limit is, etc"
Not legal so am having a good go at them.
See my supposed CCA and T&C in my thread in here.
Ive had a Tradepro Card since late 2004. Always paid it on time, never been late, they even upped my limit a couple of times. Anyway, point is, thier rate of interest is extorionate, I dont like thier general attitude on the phone, the girls who work for them are very jobsworth and a high and mighty attitude, and you'd think it was thier money they were lending and not Tradepros'. Anyway, I dont feel like paying them any more, and it is my firm intention to knock them good and proper. I owe them 7000.00. Dont mind paying my bills, used to be a very honourable person, but not now, as all these banks and financial institutions are just too damn greedy. Have no respect for them, except Barclays who I have banked with for 12 years, and have fantastic trading relationship with them. Cant fault them.
Anyway, the point is that I have been sent (at my request) a mickey mouse photostat copy of "an agreement" signed by me but very rough in some places and cant be read that clearly. The agreement dosent have the T&C's on the same sheet of paper (one document) so as far as Im concerned its not valid. Im genning myself up at the moment on the 1974 Act which applies to all my cases, and it is my intention to have a go at every company who I deal with or dealt with in respect of charges, agreements etc etc.
When I signed this "agreement" with Tradepro, they are so kamakaze about documentation and greedy for business, they asked me to fax back the so called agreement. I recognised my blank fax heading at the top, so Im pretty sure that they dont have the original.
Spoke to some muppet today and he didnt know what SAR was (Subject access request). When he did find out after about 5 minutes, the first thing he told me was that it would cost 10.00 !! Money grabbing again !!!
I am out to get these people, in a legal way, you understand, and if I have success with them, I would urge everyone else who has got a Tradepro Card top do the same.
At this stage, I would like to think that thier agreements are unenforceable. As soon as Ive sent them a formal SAR I will wait and see, and then the fun will really start !!!! He didnt even know about the 12 day limit on SAR rules. Where do they get the staff from.
Best Regards to all in fighting your respective battles with the parasites.
Hi Loanbuster
I have the same case in the court with tradepro . I'm preparing defence now. do you have some suggestions? I think that I should go to a solicitor I don't want to let them win. Thank you for all advices if you find a time.
Mmm we have a trade pro court case in motion, original debt was for around £6,000, claim was for £12,000 due to their fee's or whatever they call them, CCA'd them 3 times long before any legal action had been started, and received 3 application forms, so watching this threat with great interest. Hubby is being made B/R at the end of this month so they wont get anything anyway.
The have filed against me for a company account with only an "application form".
£5900 spend, £5600 paid back, claim for £9600 with their fees.
Told them I'll see them in court.
They came back with an offer of £4.5k after removing the "collection charges" and interest.
Told them I'll see them in court.
Don't mind paying interest, etc but not at nearly 50%.
They have now come back with a lower offer after I pointed out the poor management, lack of statements, breaches of protocol and legislation - Ltd company account and
they issued 2 defaults under the CCA.
Can't be arsed to go to court just in case the judge had a bad day and the latest settlement offer is not bad as interest goes.
If you have a sole trader account with them then f*ck em as the agreement is tosh.
Could I borrow your letter Hammyuk, the breeches etc, I have been disputing our account since Oct 08 as I said 3 times CCA request and 3 times all they produced was an application form highlighting signiture box, but they have still issued a court claim which is at the aq stage (already sent off) I can usually find what Im looking for on here without bothering anyone but Trade Pro card Im not sure about.
Thanks
Cheers Hammyuk, i am going to court so im feeling a bit more confident abuot the whole thing now. would be interested to hear from anyone who has already done it ,how they got on and any tips ?
They have been writing to me for months. Many phone calls, same old story. The alleged agreement that I signed was faxed back to them, so that they cannot possibly have an original document, all in one piece, which prescribed terms embodied on the document. Some of it is faded, and some words are not legible. Thier solicitors wrote to me, and I asked them for copy of "agreement". They sent me another copy of the same document, but also enclosed a blank specimen copy of a full sized A4 document which was meant to give me a resemblance of what I allegedly signed.
The whole company is a joke, and the way they run things is an even bigger joke. My advice - knock them - see you in Court, and apply for an unenforcibility order. Ive had Counsels' Opinion on a Tradepro agreement - he laughed !!!!! Well thats my experience with them, Im waiting for thier next move !!!!!!!!!!!!!!!
They took me to court over a company account.
Filed defence, stating breaches in CCA, default notices under CCA when B2B agreement, etc.
Got a letter back stating withdrawl of case from court, "we hope to hear from you soon".
That was 3 months ago, not heard anything since.
