This may seem ironic, but because of all the charges I ended up signign a Trust Deed (I.V.A. in England & Wales) and part of it was to have some debts to the R.B.S. (Credit Card and overdaft) written off. IF my claim to get the bank charges are successful can they claw the money back???
I've replied on your other thread but I see this is a trust deed (which is better than an IVA is some ways). So the answer is if it is protected and you claimed back your charges the bank could not keept your money however your trustee would almost certainly want most of it unless you didn't tell them which I would not advise. As the bank may inform them anyway.
It may be best to talk to them first and see what they say.
