    Default Help needed, Abbey filing default on overdraft

    Guys,

    Please help, Im struggling with the minefield that is Abbeyicon!!!
    Today I received a letter from Milton Keynes posting notice of intention to register a default on our account.

    This is despite writing to Allen Betts (Head of Unsecured debt managementicon) twice before explaining that the account is in disputeicon and the disputed amount is more than owed.

    I really worried now, because I had a default 6 yearsicon ago which crippled us .

    Each time I have copied head office, and I sent a copy to the court with my allocation questionaire. I feel like Abbey are threatening me!!!

    What next?????

    Have rung the Ombudsmanicon, they say quite clearly that they wont involve themselves with a dispute that is already progressed to court stages.

    Also rang the Banking Codeicon of practice people, and again, they say that as far as Abbeyicon would be concerned, there is NO dispute that I owe the money and therefore have every right to default the account.

    Right now off to ring the court........

    Funnily enough I have had a similiar phone callicon this morning. I told them where to go in no uncertain terms. It appears that none of these departments talk to each other.
    I wouldn't worry.
    They know they owe you money.
    They know the account is in disputeicon.
    You have made it clear that the amount owed to you is more than the overdrafticon.This could even be construed as an offer to clear it, it's Abbeyicon who are holding up the process.
    Part of your demands should include removal of default if they go ahead anyway.
    Don't be bullied.You are nearly there.

    Thanks Glennboy, rang the court and they said I could fill out an N244icon to possibly prevent Abbeyicon defaulting. (more money!!! £35)

    How can I add removal of default to my already submitted claim, without costing anything?

    Don't think you can avoid the fee. Mind you, £35 is a small price to pay if it prevents the default!

    NatWest: £4529 Claimed 10/05/06 - Paid in full 1/08/06
    Halifax: £1150 lba 18/05/06 - Paid in full 07/06/06

    Woolwich: £1100 Paid in full 28/2/07 + Default removed
    NatWest Pt 2: £1700 Claimed 10/05/06 - Paid in full 7/2/07 + Defaults removed

    Abbey Pt 2: £2300 + adverse credit removal claimed 23/03/07

    Hi there,

    Abbeyicon have already file a default against my account in January. n1 and aqicon submitted and filed in December. Abbey settled in full March 2 days prior to court hearing.

    Am I right in saying that Abbey shouldn't of filed a default against me while the account is in disputeicon, I do remember writing a letter to Moorcroft DCAicon that the account is in dispute.

    I have now settled the amount with Moorcroft, what steps do I take to remove the default on my credit file?

    Any help will be greatefully received.

    I managed this - I wrote in to the court and asked that the POCicon be changed to include the default on the basis that it resulted from the illegal penalty charges.
