    Default ArthurC v Halifax ***SETTLED IN FULL***

    Just sent the lbaicon off to Halifax. claiming just over £3,100. Fortunately had all my statements going back 6 yearsicon. Wouldn't have have done this without the encouragement I've gained from this site.

    After receiving a letter acknowledging my complaint on Tuesday ,enclosing the complaints procedure and saying they would be investigating my complaint, yesterday I received a phone callicon from a Customer relations manager in Leeds. I ended the conversation by politely stating I didn't wish to discuss my claim over the phone as I preferred to deal with it in writing.
    Today have received a letter from the same person. It says the usual thing about how they are commited to good banking practice but reminds me about the terms and conditionsicon of my account and that it is my responsibility not to authorise payments against funds that were not available. It then goes on to give me some brief advice how I might keep track of my account.
    It further goes on to make me an offer of £200 as a goodwill gesture in Full and finalicon settlement of my complaint and enclose a form of acceptance which they ask me to return if I accept their offer.
    Interestingly the letter queried the amount I was claiming and enclosed a list of the charges that they stated was for the last 6 yearsicon which was about half what I was claiming . On checking this it turned out it was only for the last 2 years!
    To my request to give a full Breakdownicon of their costs incurred they stated that they were under no statutory obligation to record the information therefore they were unable to comply with my request.
    Needless to say I won't be accepting their offer!! I will keep you posted.

    seems they send a bog standard letter to each and everyone of us, im about the same stage as you, so will see how you get on compared to me, good luck

    Bog Standard blah blah blah letter received 22nd May 2006.
    received lengthy letter dated 24th May 2006 offering £605 pah!
    letter before action sent registered 5th June 2006
    letter received in response to lba offering £1801.00 errrrr no ta
    court action filed 23rd June 2006
    deemed served to bank on25th June 2006
    notice of acknowledgement of service has been filed
    they intend to defend
    7th july received letter PAYING IN FULL!!!

    10th July cash deposit £112.58
    10th July cash deposit £2869.00


    HALIFAX SETTLED IN FULL

    I have just sent off by recorded mail letter giving them 14days to pay before I take action. Have said that I will accept their offer of £200 as a good will gesture but I still require payment of the full amount claimed.

    Haven't received anything back from Halifaxicon further to my lbaicon letter. I am now just about to file the court claim via the moneyclaim site. In the details of the claim section I was going to use the template that was posted by BankFodder but drawn up by rbrears. Only problem this is more than the 24 lines and 1048 characters presribed in the moneyclaim online form.
    Can anyone help on this please?

    I note in another thread a mod has advised one of the group after filing moneycalim to send a schedule of the charges (spreadsheet) to the legal department of Halifaxicon. Is this right?

    Received notice this AM that Acknowledgement of service has been filed by Halifaxicon on 23rd. They intend to defend and have 28 days to file defence. Let's see what they do! By my reckoning that gives them until 21st July

    Yes. Thanks for reminding us of that. In effect it gives them an extra 14 days on top of the 14 days from service if they hadn't acknowledged
