Barclays 'Judgement by Default' ***WON POST_OFT***
Hi everyone, just a quick one, gone through everything with Barclays, upto them acknowledging court papers, however today is the 30th day after issuing the papers and they have not yet submitted a defence.
Can i apply for judgement by default now? and has anyone else managed to succeed with barclays in this way? i can't beleive they've overlooked this one!

the bank has until midnight tonight hun, so i would leave it until tomorrow then u can file judgement mine is up tomorrow at midnight so fingers crossed

how do they get away with it?? especially when the courts know that the b's won't go to court anyway, what a waste of money and court time, english justice system needs to fire the banks up a bit i think!!
In mine, they failed to file their defense, but the court gave them one last chance and an extra week to submit their whole court bundle early otherwise they would allow me to enter judgement. However they have agreed to settle in full one day before the deadline. I guess I was lucky as it was bank holiday, most of that extra week they were allowed, they weren't there and they only just got the letter today.
Is that to me? no, they just settled today one day before I could enter judgement. I'm just waiting for the money to go into my account before I tell the court. I did the aq a while ago before I got the first draft order.

I have entered judgement today let me do it BUT I have not filled out AQ form
I'll try and file the default tomorrow and see what happens, with any luck the court will apply it, do i still have to fill out an aq? if judgement is applied for before a defence is submitted? cheers for all the responses,

Typical!!!! , just logged onto moneyclaim and see that they have filed a defence in the last closing seconds!! Oh well i guess we'll have to see what happens next? If i end up in court so be it.. keep at it evey one!!
Here we Go! Just received the standard defence from Barclays from the court, case being transferred to Torquay. However i would have expected to receive an aq at this point but on the covering letter it states:
"the filing of an allocation questionnaire be dispensed with in this case unless the District Judge at the court of transfer orders otherwise"
has anyone else received this and does it mean there will be no AQ?
This is a relatively new thing but now more and more common,
what is happening is that judges are realising this is aa game to B's and they have no intention of attending court, so they are dispensing with the stage of the aq in order to speed things up and clear the courts.

This means you are a step closer to getting your court date,, v good news for you cos then you can start comms with B's about settling out of court, they wont even entertain the idea until a date has been set.
