Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have sent Beneficial the lba letter and got the usual 'get stuffed' letter.
This morning had a call from a young lady from Beneficial asking for my monthly payment which is 2 days overdue. I explained that I had requested repayment of penalty charges and that I was now beginning legal action to recover these fees. She wasn't having any of it and became very defensive claiming that the law hadnt changed and they were within their rights to charge fees and that I would be getting more charges because of my non-payment now.
I tried again to explain that indeed the law hadn't changed and that legally I was entitled to recover the fees at which point she became agressive and stated that my account would be closed and that my details would now be passed to the legal department for recovery of all outstanding money.
I tried in vain to point out that if my account is in legal dispute the account couldn't be defaulted but it fell on deaf ears.
So today Im off to the courts. I am sooo angry with these pariah's!
I will update with court details the moment I have them.
