    Default Morris Vs Cahoot

    I'm new to the site so would appreciate any help I can get from you guys. I've spent ages looking at some of the posts on here and although a lot of it seems straight forward a lot of it is just mind boggling.

    I am using mine as a test bed for putting through claims for my friends and family so I am obviously keen to get this right first time.

    I put a claim in for a SARicon with Cahoot (which they received 6/3/07) along with some other banks. Cahoot have until the 15/04/07 as I see it to come up with the request which covers a credit card, a loan and a current account. All of which I defaulted on and since had my accounts managed by the CCCS.

    I would not be in the position I am in now had it not been for bank charges whilst I was at Uni. I now can't get a mortgage and even find it difficult to get a mobile phone on contract and all because of the chain of events leading form bank charges.

    Will I get my default taken of my file for all my accounts? I don't know. Will I get to repair my credit rating from this process? I hope so.

    Please follow my case and help as much as possible.

    Just to confirm if I don't receive the statements do I then (1) inform the ICO (2)Send them an lbaicon and then (3) Launch a Court Order all at the same time. Or do I wait till the days are up after the LBA to raise the court order.

    Hi Striker,

    Welcome to the site.

    If you don't get your statements on time send the lbaicon then after the time has expired in the LBA complain to the ICO and make a court action. But hopefully it won't come to that.

    Removing defaults is a little more tricky. Some companies are obliging and others are a little more obstinate.

    Right I've sent my Prelim letter off to Cahoot today. Charges totalled (with interesticon) £1200.

    Giving them 14 days before I put my foot down.

    I hear they refuse point blank to pay out. I'm a bit worried though as I sent everything to CCCS a few years ago. Will Cahoot demand all the money back or will they still honour the payment agreement with CCCS. I thought that if they give me £1200, then they would expect me to give it back to reduce my debt.

    I'm also claiming though Natwesticon, Barclaysicon and Barclaycard, all of which have not complied with my DPA request. Some have but only sent me half the statements, Barclays haven't sent me anything. 40 days are up now so lbaicon sent today.
